Application For Isbat Trial Rejected, Rizky Febian And Mahalini Must Renive

JAKARTA - Public Relations of the South Jakarta Religious Court, Suryana said that the request for a trial for the isbat of Rizky Febian and Mahalini was rejected by the panel of judges.

This was decided after their marriage was deemed not to fulfill one of the marriage pillars, namely the guardian who married him was not the Head of the KUA or the Minister of Religion.

"Who is appointed by the guardian of the judge in the law is in the regulation of the minister of religion that the guardian of the judge in number 30 of 2005 that who was appointed as the guardian of the judge was the minister of religion and then the last delegation was carried out by the head of the KUA. That is the guardian of the judge," explained Suryono at the South Jakarta Religious Court, Monday, November 25.

"Yes, it was automatically rejected because the marriage did not fulfill one of the marriage pillars," he continued.

Suryono said that at the time of the consent, the only person who married him was a ustad who called himself the guardian of the judge.

"Now in the trial, it was found that the fact that he married him was a ustad. So the cleric married him on behalf of himself as the guardian of the judge because he did not have a guardian," explained Suryono.

As a result, Mahalini and Rizky Febian are required to remarry so that they can be registered legally or stately.

"That's why it must be a solution like that so that he gets a marriage book, so that his marriage is also good and legal according to religious rules, state regulations, it can be proven, yes, having to remarry like that," he said.
