The Constitutional Court Temporarily Stops Testing The Law During The Trial Of Pilkada Disputes
JAKARTA - Chairman of the Constitutional Court (MK) Suhartoyo said his party had temporarily suspended the trial of the judicial review (PUU) during the trial of the dispute over the election results in the 2024 Pilkada.
"Yes, the PUU is temporarily suspended. Indeed, there is a Constitutional Court regulation, when there are special handling, the PHPU for the legislative elections, the presidential and regional elections, the law testing case can be postponed," Suhartoyo said as quoted by ANTARA, Monday, November 25.
The Court's authority to postpone the trial for testing the law is regulated in Constitutional Court Regulation Number 2 of 2021 concerning Certificates in Law Testing Cases (PMK 2/2021).
Article 82 PMK 2/2021 regulates that in the event that the Constitutional Court implements other powers which coincide with the stages of the law testing case, the trial stages of the law testing case will be adjusted to the implementation of other powers in question.
"So far, legal testing has always been suspended," added the Chief Justice of the Constitutional Court.
Suhartoyo did not explain further about when the suspension would be. However, based on the official website of the Constitutional Court, the trial for testing the law is still scheduled until December 3, 2024.
Meanwhile, the Constitutional Court will receive registration for regional election disputes for a maximum of 3 working days after the KPU announces the determination of the vote results. This means that the registration of regional election disputes is opened by the Constitutional Court in the period 27 November 18 December 2024.
Referring to PMK Number 4 of 2024 concerning Stages, Activities, and Schedules for Handling Disputes over General Election Results for Governors, Regents, and Mayors, the trial for expressing the election dispute decision is scheduled for February 24 and March 11, 2025.
On the other hand, the Constitutional Court has also handed down an interim decision for one of the law testing cases, namely Case Number 132/PUU-XXII/2024 related to formal testing of Law Number 32 of 2024 concerning Conservation of Biological Natural Resources and Their Ecosystems.
In the interim decision, the Constitutional Court stated that it had postponed the examination of the trial of the case until the completion of the trial for the settlement of the 2024 Pilkada dispute case.
