South Jakarta District Court Tom Lembong Pretrial Session Held Today

JAKARTA - The inaugural trial of Thomas Trikasih Lembong's pretrial lawsuit or Tom Lembong regarding the alleged corruption case of sugar importation will be held at the South Jakarta District Court, Monday, November 18.

Tom Lembong is known to have officially filed a pretrial lawsuit regarding whether or not the suspect was determined against him.

The defendant in the pretrial lawsuit is the Director of Investigation of the Deputy Attorney General for Special Crimes at the Attorney General's Office (AGO).

The plan is that Tom Lembong's pretrial trial will be held at 09.00 WIB.

According to Tom Lembong's attorney, Ari Yusuf Amir, the pretrial lawsuit was filed because there were allegations of an arbitrary investigation process.

In addition, it is believed that the determination of the suspect against Tom Lembong is not based on two pieces of evidence according to the Criminal Procedure Code (KUHAP).

"The legal advisory team considers that the evidence used by the Prosecutor's Office does not meet the specified requirements so that the determination of the suspect becomes a legally flawed," said Ari.

Meanwhile, Kejayang has named Tom Lembong as a suspect in the alleged corruption case of sugar imports. This is because Tom Lembong, who while serving as Minister of Trade allowed the import of 105 thousand tons of sugar to private companies.

Tom Lembong's decision has violated the Decree of the Minister of Trade Number 527 of 2004. In that regulation, only state-owned companies are allowed to import sugar.

In this case, Tom Lembong is suspected of being under Article 2 Paragraph 1 or Article 3 Juncto Article 18 of the Law of the Republic of Indonesia Number 31 of 1999 as amended by Law Number 20 of 2021 Juncto Law of the Republic of Indonesia Number 31 of 1999 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Corruption Crimes Juncto Article 55 Paragraph 1 to 1 of the Criminal Procedure Code.
