The Attorney General's Office Affirms That There Is No Criminalization Of The Case Of South Tapanuli Prosecutor Jovi Bachtiar Because Of The Hoax Of The Asusila Service Car
The Attorney General's Office (AGO) confirmed that the institution has never criminalized a prosecutor in South Tapanuli named Jovi Andrea Bachtiar.
"The Prosecutor's Office has never criminalized its employees, but it was the person concerned who criminalized himself for his actions," said Head of the Legal Information Center (Kapuspenkum) at the AGO Harli Siregar as reported by ANTARA, Friday, November 15.
It is known, Jovi Andrea Bachtiar is a prosecutor at the South Tapanuli District Attorney's Office (Kajari Tapsel). His name was widely discussed by netizens after being sentenced to two years in prison for uploading a narrative on social media accusing his colleague, Nella Marsella, of using an official car for immoral acts.
According to Harli, Jovi tried to twist the issue from what actually happened, so that the public was divided on their opinions on social media.
He emphasized that Jovi faced two problems, namely criminal cases and disciplinary penalties for civil servants (PNS).
Regarding the criminal case, Harli said that Jovi was a defendant for violating the ITE Law because he was charged with spreading information that violated decency through his social media account.
He explained that Jovi made a narrative on social media that attacked the honor of the victim Nella Marsella. However, Jovi never apologized to the victim and the victim felt embarrassed and harassed, so the victim reported Jovi to the South Tapanuli Police.
"The upload was indecent words, accusing the victim of using the official car of Kajari Tapsel to have sex or have sex with the victim's girlfriend. In fact, it was only fabrication and tricking the person concerned," he said.
Meanwhile, when Jovi's status was declared a suspect and detained, the prosecutor was temporarily dismissed from his status as a civil servant based on applicable legal provisions.
In addition to committing the ITE crime, continued Harli, Jovi has also been proposed to be given a severe disciplinary punishment because for 29 days the accumulation of not entering the office for no valid or clear reason. This act has violated Government Regulation Number 94 of 2021 concerning Civil Servant Discipline.
"So far, efforts have been made to foster and mediate, but the person concerned has always shifted the issue with other topics on social media as if he was a legal warrior and truth," said Harli.
