Mahfud MD Regarding The Tom Lembong Case: In Law, Corruption Is Not Just Due To The Flow Of Funds
MahfudMD said the alleged corruption case of sugar imports at the Ministry of Trade in 2015-2016 by Thomas Trikasih Lembong or Tom Lembong had met two elements even though the person concerned did not receive the flow of funds.
"For the case itself, which the community says is Tom Lembong, there is no corruption because there is no flow of funds for those who enter. That can't be because in the law, corruption is not just a flow of funds, the formula is to enrich oneself or others," Mahfud MD said as quoted by ANTARA, Wednesday, November 6.
He said many views in the midst of society stated that Tom Lembong was not corrupt because he did not receive money from the case.
However, said Mahfud MD, the Attorney General's Office has fulfilled two elements to make Tom Lembong a suspect.
The first, said Mahfud, is that in the law, corruption is not just a flow of funds, the formula is to enrich oneself or others.
"If it gets an unfair advantage, the first element of corruption is fulfilled, the second element is to violate the law if there is no debate," he said.
In addition, Mahfud MD said that if there were people who stated that Tom Lembong was criminalized because the previous minister was safe, that would be normal.
"Some suspect that it was criminalized, why is it suspected that it was criminalized because Tom Lembong made a policy that made him a suspect in 2016. And the same policy was carried out much bigger by the next Minister of Trade, Enggar, Agus, Lutfi, Zulkifli Hasan," he said.
