KY Is Still Waiting For The MKH Regarding The Sanctions Of 3 Judges At Ronald Tannur's Trial

The Judicial Commission is still waiting for the Supreme Court to form an Honorary Council of Judges (MKH) to follow up on sanctions for three judges at the Surabaya District Court who acquitted Gregorius Ronald Tannur.

"At that time (KY) had sent a letter to the Supreme Court to form the MKH. Currently, what KY will do is just wait," said Head of the Judicial and Investigation Supervision Division of KY Joko Sasmito as quoted by ANTARA, Wednesday, November 6.

Joko explained that the task of KY in examining ethical violations against the three judges of the Surabaya District Court was completed last August. As a result, KY decided that the three judges were proven to have violated the Code of Ethics and Code of Conduct of Judges (KEPPH).

KY imposed sanctions for dismissal with the right to retire to the three judges in question. However, to follow up on these sanctions, it needs to be decided through MKH.

MKH, he continued, consisted of seven people, namely three of the Supreme Court judges and four people from KY. Therefore, the establishment of MKH must have approval between the two institutions.

"To date, KY is still waiting," said Joko.

Three judges from the Surabaya District Court, namely Erintuah Damanik (ED), Heru Hanindyo (HH), and Mangapul (M), sentenced Ronald Tannur to acquittal for the murder of Dini Sera Afriyanti.

The acquittal has drawn controversy. The Surabaya District Attorney's Office declared an appeal for the verdict, while Dini Afriyanti's family reported the panel of judges to KY.

Based on the examination, KY stated that the three reported judges were proven to have violated ethics, resulting in severe sanctions. The recommendations for sanctions have been submitted to the Supreme Court, but the ethics trial process through the Constitutional Court has not been carried out because the Supreme Court at that time was still waiting for the final results of the cassation case.

Ronald Tannur's cassation case was decided on Tuesday (22/10). The cassation panel sentenced Ronald Tannur to five years in prison, so that the acquittal in question in the first instance court was declared null and void.

However, the day after the cassation decision, Wednesday (23/10), the Attorney General's Office named three judges at the Surabaya District Court, namely ED, HH, and M as suspects in alleged bribery or gratification while handling the Ronald Tannur case.

Thus, until now the MKH to follow up on the KY sanctions has not been formed.

Related to this, MA spokesman Yanto has explained that MKH is a forum to try out judges' problems. When the judge is caught in a criminal case, the process of dismissal is carried out based on the results of evidence from law enforcement officials.

Yanto gave an example of the case of former Supreme Court Justice Sudrajad Dimyati who was involved in a bribery case and was dismissed as a judge after a court decision had permanent legal force.

"Like the case that has been going on before, the case is Mr. Drajad and also his proof at the APH (law enforcement officers). Once it has permanent legal force, the person concerned is immediately proposed to dishonorably dismiss," said Yanto in Jakarta, Thursday (24/10).
