New Surpres Regarding KPK Capim Will Be Sent By Prabowo To DPR
President Prabowo Subianto is rumored to be issuing a presidential letter (surpres) regarding the list of candidates for leadership and supervisory board of the Corruption Eradication Commission (KPK) to the DPR.
This was conveyed by the Minister of Law (Menhum) Supratman Andi Agtas in response to the candidates for the leadership and supervisory board of the KPK which had not been discussed until now by the DPR. According to him, this step was taken by Prabowo following up on a letter from Senayan to the government recently.
"As far as I know, the leadership of the DPR has sent a letter to the president. The President will also answer in the near future regarding the letter from the leadership of the DPR," Supratman said, Monday, November 4.
Supratman has not yet detailed the letter. However, he opened the opportunity for a change in the name of the candidate for leadership and supervisory board of the KPK.
Supratman explained that Prabowo had the right to reshuffle or maintain the name of the selection committee (pansel) which had been handed over by President Joko Widodo (Jokowi) before stepping down.
"It depends on the President (Prabowo Subianto, ed)," he said.
"Yes, both of them, he wants to sell the same names, use the other committee for the president. Or want to form another, we depend on the president," continued Supratman.
Prabowo is also said that Supratman has the right to reshape the selection committee. Therefore, he asked all parties to wait further for the steps to be taken by the former Minister of Defense (Menhan) of the Republic of Indonesia.
"We'll just wait for the president's answer to the DPR. Definitely not too long, I think," said the Gerindra Party politician.
As previously reported, a number of parties asked President Prabowo Subianto to re-shuffle the names of candidates for the leadership and supervisory board of the KPK. This is because President Joko Widodo (Jokowi) is considered not to have the right to submit it to the DPR.
One of those who refused was the Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman, who had written to President Prabowo. He urged Jokowi's recommendation to be withdrawn.
"Only Mr. Prabowo has the authority to form the KPK Pansel and ignore the results formed by Jokowi," Boyamin told reporters, Tuesday, October 22.
Boyamin alluded to the decision of the Constitutional Court (MK) Number: 112/PUU-XX/2022 page 117 of the last paragraph and 118 of the first paragraph. Here are the details:
"That the term of office of the KPK leadership given by Article 34 of Law 30/2002 for four years and can be re-elected for one term of office has turned out to have resulted in one term of office of the President and the DPR, namely that during the five years in cash for the 2019-2024 period, two assessments of KPK institutions, namely in terms of selection or recruitment of KPK leaders.."
In this case, institutionally, the KPK is treated differently from other supporting state institutions but belongs to the institutional importance which is both independent and formed based on the law because of the independent institutional importance which has a five-year tenure, it is considered as one time during the term of office of the President and the DPR.
