Political And Legal Challenges Of The Prabowo-Gibran Government Era
JAKARTA - After being inaugurated and appointing his ministers President Prabowo Subianto to bring ministers, deputy ministers and heads of agencies in the Red and White Cabinet to the Military Academy, in the Tidar Valley, Magelang, Central Java to follow the retreat and debriefing. The training at the military education site was to establish cohesiveness, discipline and loyalty before they began joining the Prabowo-Gibran government cabinet.
This is a new tradition and it seems that it will first occur during the reform era. I deliberately chose the Tidar Valley to invite the leadership of the government of the Republic of Indonesia for up to five years to come, that the Tidar Valley is part of a long struggle area," Prabowo said in his remarks, as quoted on the official website of the President of the Republic of Indonesia.
In the midst of public gossip about the current fat number of Prabowo-Gibran cabinets. Prabowo's total number of cabinet ministers reached 109 people, consisting of 48 ministers, 56 deputy ministers, and 5 heads of non-ministerial institutions. The cabinet, which carries sustainability and unity, indeed accommodates many people, especially members of the coalition and tries to embrace other groups outside the coalition. The cabinet will focus on the economic issue.
However, it does not cover attention to political and legal issues. One of the indications is that there is an expansion of the current ministry of law. The Minister of Law was broken down into three different ministries. Among others, the Ministry of Law, Ministry of Human Rights and the Ministry of Immigration and Corrections. With their respective ministers Supratman Andi Agtas as Minister of Law, Natalius Pigai as Minister of Human Rights, as well as the Minister of Immigration and Corrections held by former Deputy Chief of Police Agus Andrianto. Meanwhile, as Coordinating Minister, Yusril Ihza Mahendra and his deputy Otto Hasibuan were held.
Prabowo Subianto's leadership as president and Gibran Rakabuming Raka as vice president faced various challenges in politics and law. This challenge will affect government stability and success in achieving long-term goals, including the vision of Indonesia Emas 2045.
So that from the start Prabowo wanted to bring his friends and opponents into ranks. No exception parties that are opposite, such as PDIP, are sought to enter the government, in order to smooth the way of government. "Why are you fat, because of the need for the elected president to ensure political stability in parliament and outside parliament," said Arya Fernandes, Head of the Department of Politics and Social Change at the Center for Strategic and International Studies (CSIS), as quoted from Antara.
Prabowo did want to seek the consolidation and stability of his government from the start. Managing a broad coalition with various political parties is a major challenge. The government must be able to accommodate various interests without sacrificing policy effectiveness. Inequality in the coalition can cause internal conflicts that hinder government performance.
Political management which is also considered important is a matter of regional autonomy and regional synergy. Obstacles faced in the issue of relations between the central and regional governments often hinder the implementation of policies effectively. Improvement of communication and cooperation between the center and the regions is needed so that autonomy does not reduce national cohesion.
The Prabowo government must also seek to strengthen democracy and election integrity, which was dim during the Jokowi administration. Including money politics and manipulation in the election process are serious challenges. So that the new government must strengthen election institutions and increase transparency and accountability in the electoral process in order to maintain public trust.
Meanwhile, in the legal field, there are a number of homeworks that must be addressed by the Prabowo-Gibran government, namely the issue of eradicating corruption. Where corruption stagnation continues to decline. Corruption remains a big threat to governance. Prabowo-Gibran needs to strengthen law enforcement agencies such as the KPK and take firm action against corruption, especially in strategic sectors such as energy and mining.
Apart from corruption, today's law enforcement problems are serious issues. Many people think that law enforcement is often related to political intervention. The independence of judicial institutions is very important to ensure the rule of law. The government must ensure law enforcement runs without political pressure, in order to increase public trust and investors in our justice system.
Prabowo's government must be able to fix bureaucratic reform and legal certainty. An efficient bureaucracy and clear regulations will strengthen the investment climate. For this reason, the government needs to focus on bureaucratic reform and legal certainty so that investment and development can run smoothly. This new government needs to take strategic steps to create stability and increase transparency. By overcoming these challenges, Prabowo-Gibran can lay a solid foundation in realizing the vision of Indonesia Gold 2045.
No Checks
Regarding legal handling, Indonesia Corruption Watch (ICW) provides notes on the formation of Prabowo's fat Cabinet. ICW stated that it doubted the cabinet's anti-corruption commitment. "Moreover, the appointment of ministers and deputy ministers seems to prioritize accommodative political aspects, regardless of track record, integrity, and competence" ICW wrote in a press release, October 24.
ICW also provided at least 6 notes on the formation of Prabowo's cabinet, they assessed that the election of ministers and deputy ministers ignored integrity and legal records, because there were a number of cabinet members with track records being examined, even said to have received corruption money in court facts.
Prabowo is also considered not to have used state instruments to carry out in-depth checking of candidate track records. Such as the Corruption Eradication Commission (KPK), and the Financial Transaction Analysis Report Center (PPATK). There is also no clear assessment indicator, especially against former President Jokowi's ministers. Where there are 18 ministers and deputy ministers of Jokowi's government. In addition, cabinet elections are more dominant in transactional politics sharing cakes'' ministers.
Chairman of the Indonesian Legal Aid Foundation (YLBHI), Muhammad Isnur also provided notes on the legal development in Prabowo's Cabinet. He wants the restoration of enforcement to be punished. Obstacled law enforcement, for example, found the judge's bribery case. Isnur also expressed his disapproval with the separation of the legal ministry into 3 ministries. "It's better to return Ham to the Ministry of Law." Isnur said, contacted by VOI, October 27.
Things that must be corrected in the field of law, according to Isnur, include immediately revoking or revising laws that displace the people, such as the IKN Law, the Minerba Law, the Job Creation Law must return again. Also immediately ratify bills that favor the people, such as the Indigenous Community Law and the Asset Confiscation Law
