Protect The Curator And Management Profession, Resha Agriansyah: Bareskrim And AGO Open Opportunities For Cooperation

JAKARTA - The National Law Seminar entitled The Criminalization Phenomenon of the Curator Profession and Management in PKPU and Bankruptcy Porses held by Resha Agriansyah Learning Center (RALC) provides positive results for the protection of administrators and curators in carrying out their duties.

"Earlier, as we heard in seminars, the Indonesian Criminal Investigation Unit and the Indonesian Attorney General's Office opened up opportunities for cooperation," said RALC Founder, Dr. Resha Agriansyah to reporters, Saturday, October 5.

According to Resha, recently many curators and administrators have been reported to the police and the Prosecutor's Office when carrying out their duties.

Many of those reported have not committed violations or criminal acts, and this can be considered as a form of criminalization for curators and administrators.

This is of course a concern in itself how to protect curators and administrators in carrying out their professions.

"This is already an opportunity for protection, from the Indonesian Criminal Investigation Unit with the MoU, and the Indonesian Attorney General's Office through a letter of protection from the Association. I have opened the way, how will the association continue," he explained.

In the seminar, the Head of Sub-Directorate for Pre-Prosecution at the Directorate of Crimes Against State Security, Public Order and Other General Crimes at the Attorney General's Office, Syahrul Juaksha Subuki, conveyed two concrete solutions to protect curators and administrators in carrying out their professions.

For the first solution, namely in the short term, he is committed to the Association expressing its view that there are curators and administrators who have been reported to the Prosecutor's Office for being accused of committing a crime.

Later, the view of the Association will be taken into consideration in processing these allegations.

"If there is a curator who becomes a suspect, there is a view from the association, just convey it to us, later it will be our consideration to be more objective. Later I will report it to the leadership, Mr. Director if I promise that. The association sends a letter to us for legal protection, later we will assist and supervise it if the elements of the crime are fulfilled. We also do not know that there are afraid that there will be prosecutors who will receive certain orders," he said.

While the second solution is for the long term, he also encourages the revision of the Bankruptcy Law and PKPU so that later there will be immunity rights for curators and administrators in carrying out their duties.

Syahrul gave an example of the notary profession, when there were allegations of criminal acts, the Prosecutor's Office asked for views from associations regarding this matter.

Meanwhile, the Criminal Investigator for Special Economic Crimes at Bareskrim Polri Kombes Didik Sudaryanto also said that if handling cases related to certain professions such as curators and administrators, cooperation is usually carried out in the form of a memorandum of understanding.

"MoU, we put together the guidelines, the basis is MoU," he concluded.

Resha Agriansyah hopes that in the future the krator profession will have a Curator Professional Law and Management so that there is the right of immunity for the curator profession and professional protection can be guaranteed.
