Claiming To Be An Indonesian Citizen When Managing Passports, A Foreigner From Pakistan Was Secured By Jember Immigration

JEMBER - The Jember Class I Immigration Office, East Java secured a foreign national (WNA) from Pakistan with the initials MK who wanted to illegally apply for a passport from the Republic of Indonesia at the local immigration office.

"Officers found suspicions about the validity of the required documents brought to apply for passports," said Jember Immigration Office Head Henki Irawan, quoted by ANTARA, Monday, September 23.

He explained that officers also found suspicions from the pronunciation and use of Indonesian which felt odd for an Indonesian citizen (WNI).

"The foreigner is from Pakistan and has a Pakistani passport. The results of our examination show that the person concerned has a Pakistani passport that entered Indonesian territory in May 2024 via the rat route, so he does not pass through the Immigration checkpoint," he said.

He explained the purpose of the Constitutional Court to Indonesian territory to live with his wife in Sukorambi District, Jember Regency. However, the MK's attitude is certainly not justified because it has violated immigration regulations.

Head of the Immigration Intelligence and Enforcement Section of the Immigration Office Class I TPI Jember Gatot Wirawan said the Constitutional Court violated articles in immigration law and would be subject to immigration administrative action.

"Based on the examination of the Constitutional Court, the person concerned violated Article 113, Article 119, and Article 126 letter C of Law Number 6 of 2011 concerning Immigration so that the Constitutional Court was subject to immigration administrative action in the form of deportation," he said.

He explained that deportation was a forced action to expel foreigners who did not have official documents from Indonesian territory, while the Constitutional Court was also accompanied by countermeasures, namely prohibited by perpetrators of immigration violations from entering Indonesian territory for a certain period of time.

"Deportation and deterrence actions imposed on the Constitutional Court are not only a form of immigration law enforcement but also aimed at causing a deterrent effect," he said.

The Constitutional Court will be deported to leave the territory of the Republic of Indonesia and the prevention is not allowed to be in Indonesian territory for a certain period of time so that it can provide a deterrent effect to him.
