Democrats Kubu Moeldoko Will Continue Lawsuit To PTUN, Say Thank You To Yasonna And Mahfud

JAKARTA - The DPP of the Democrat Party in Moeldoko's camp respects the decision of the Minister of Law and Human Rights (Menkumham) Yasonna Laoly and Menkopolhukam Mahfud MD who rejected the request for ratification of the Deli Serdang Extraordinary Congress which was held on Friday, March 5.

The attorney and chairman of the Department of Communication and Information of the Democratic Party, leadership Dr. Moeldoko, Saiful Huda Ems said that his party would continue the lawsuit to the State Administrative Court (PTUN).

"Thanks to Mr. Yasonna Laoly and Pak Mahfud MD, we must continue this struggle for law and democracy at the State Administrative Court," said Saiful in his statement, Wednesday, March 31.

Saiful admitted that from the start he did not really question the results of the Kemenkumham decision. Because, even if his party wins, the AHY faction Democrat Party will file a lawsuit against the PTUN.

Likewise, when the KLB is rejected, then surely Moeldoko's Democrats will continue to take legal action by filing a lawsuit at the PTUN.

"Whether it is accepted or rejected, it will not really affect the two conflicting sides. Because the point of resolving this issue is not in the Ministry of Law and Human Rights but in the Court (PTUN)," he said.

Because of that, Saiful considered, the decision of the Ministry of Law and Human Rights was only the initial stage of the democratic struggle of the Democratic Party under the leadership of Moeldoko.

Saiful said that the Ministry of Law and Human Rights was not the court that could decide whether to win or lose "Mujahid and Mujtahid Democracy". Nor is it the final determining institution for the continuation of the fate of democracy fighters who continue to seek and fight for justice.

"So we will never give up fighting for the sake of maintaining the spirit of the Republic of Indonesia as a rule of law based on democratic values and not dynasty," he said.

According to Saiful, the door to the State Administrative Court (PTUN) is still wide open to file a lawsuit in order to obtain justice and legal certainty.

"And before there was a decision from the PTUN, it was not good for the camp that received approval from the Ministry of Law and Human Rights to applaud, moreover the facts have shown various facts that there are many violations of the Political Party Law contained in the AD / ART of the Democratic Party of 2020 led by Agus Harimurti Yudhoyono. (AHY), "he said.

Saiful understands that the Ministry of Law and Human Rights is very risky to decide this case, because it is not a judicial institution (Judicative). It is also feared that if the Ministry of Law and Human Rights wins the management of the Moeldoko camp, it will definitely be suspected of being government intervention in the overthrow of AHY from the head of the Democratic Party.

"Therefore, the Ministry of Law and Human Rights, according to my predictions, will not accept management from our side, but will still ratify the management of the AHY," he said.

Previously, the Minister of Law and Human Rights, Mr. Yasonna Laoly, who was accompanied by the Coordinating Minister for Political, Legal and Security Affairs, Pak Mahfud MD, had declared that he rejected the KLB request in his virtual press conference on Wednesday, March 31.

"There are still a number of items that have not been fulfilled, including representatives of the DPD and DPC. Thus, the government states that the request for ratification of the Deli Serdang KLB on March 5, 2021 is rejected," said Menkumham Yasonna H. Laoly.
