Sitting On The Kadin Munaslub Conflict Case: Management From 12 Provinces Rejects

The Indonesian Chamber of Commerce and Industry (Kadin) has officially replaced the position of general chairman Arsjad Rasjid with Anindya Bakrie. The decision was stated in the Kadin Musnalub at the St Regis Hotel, South Jakarta, Saturday (14/9/2024). After being elected as chairman, Anindya Bakrie expressed her readiness as a government partner.

"Kadin is a strategic partner of the government. So hopefully what my friends decided earlier can make relations with the government even better. So as a strategic partner," he said.

The schedule for the inauguration of Anindya as Kadin chairman was held on Sunday (15/9/2024). However, the election of Anindya as Kadin's general chairman as a replacement for Arsjad Rasyid has drawn many protests from Kadin members.

The head of the Kadin Munaslub, Nurdin Halid, revealed the reason why Arsjad Rasjid was removed from the position of Chairman (Ketum) of the Indonesian Chamber of Commerce and Industry. He said Arsjad, who had been the General Chair of the Ganjar Pranowo-Mahfud MD National Winning Team, was removed because he had violated the Indonesian Chamber of Commerce and Industry's articles of association.

"The Kadin organization is an independent organization, not a government organization, and not a political organization," said Nurdin. In addition, the Golkar Party politician said Arsjad should accommodate the aspirations of members and maintain organizational independence as Ketum Kadin.

"Well, that's one of the things that Mr. Arsjad didn't maintain properly. And that aspiration from below is unavoidable," he added.

Nurdin said the Kadin Munaslub was attended by representatives of 21 provincial Kadin administrators and 25 extraordinary members (ALB) Kadin. The Minister of Investment who is also the former Chairman of the Indonesian Chamber of Commerce and Industry Rosan Roeslani also came to the event. Nurdin also said that Anindya was elected as the chairman of the Indonesian Chamber of Commerce and Industry by acclamation because he won the majority of votes from the Regional Chamber of Commerce and Industry.

Before Anindya was inaugurated to lead Kadin, his party had opened registration for a candidate for chairman. However, until the end of registration, only Anindya officially registered so that he was automatically elected. Meanwhile, Arsjad Rasjid PM served as Chairman of the Indonesian Chamber of Commerce and Industry for the 2021-2026 term. On June 30, 2021, he was elected by acclamation based on a decision at the VIII National Conference of the Indonesian Chamber of Commerce and Industry in Kendari, Southeast Sulawesi.

Although the election of Anindya Bakrie to become chairman is claimed to receive a lot of support, the Kadin management from 12 provinces and the Board of Management actually expressed their rejection. Deputy Chairperson for the Organization of the Indonesian Chamber of Commerce and Industry, Eka Sastra explained, all Kadin members are required to carry out the mandate of the law and enforce AD/ART in organizational activities.

According to Eka, the Indonesian Chamber of Commerce and Industry's AD/ART regulates that the Munaslub can only be held if there is a violation of principles. But previously, there was a written warning addressed to related parties.

"Until now, we as the Board of Management have never received a warning letter regarding the violations committed by both the Board of Management and the General Chair," he explained.

According to him, the request to hold a Munaslub as well must be submitted by at least half of the total Kadin Province and half of the number of Extraordinary Members. Because these provisions have not been fulfilled, the Provincial Chamber of Commerce and Industry, Regency/City, and Extraordinary Members do not support the results of the Munaslub which was held last Saturday because they are considered to have violated the AD/ART.

The Provincial Chamber of Commerce and Industry's Board of Representatives who refused included Riau, Bengkulu, DKI Jakarta, Special Region of Yogyakarta, Gorontalo, Jambi, West Java, Central Java, East Java, West Kalimantan, South Kalimantan, East Kalimantan, Maluku, North Maluku, East Nusa Tenggara, Papua, West Papua, Central Sulawesi, Southeast Sulawesi, North Sulawesi, and Southwest Papua.

They also argue that there will be no change of chairman elected through the Munaslub as long as there are no violations or statements of officially resigning from the chairman.
