North Maluku Prosecutor's Office Issues SP3 For Corruption Cases Will Cagub Abdul Gani Kasuba's Sister
TERNATE - The North Maluku High Prosecutor's Office (Kejati) issued an Investigation Termination Order (SP3) against the prospective governor candidate Muhammad Kasuba (MK) in the corruption case in the procurement of the fast ship Halsel Ekpres amounting to Rp14 billion.
Head of the North Maluku Prosecutor's Office, Richard Sinaga, said that the corruption case in the purchase of the fast ship Halsel Ekspres involving the former regent of South Halmahera (Halsel) for two periods, Muhammad Kasuba, was stopped because there was not enough evidence.
According to him, the revocation of the status of the suspect in the Constitutional Court was based on the issuance of an investigation order by the Head of the North Maluku Attorney General's Office in 2015.
The case handled by the North Maluku Prosecutor's Office is related to the purchase of the fast ship Halsel Ekspres and two patrol boats that dragged Muhammad Kasuba as suspects in 2007.
Ricard explained, on Wednesday, August 1, 2007, based on an order from the Head of the North Maluku Prosecutor's Office at that time, with the number: print-01/S.2/Fd.1/08/2007, the North Maluku Prosecutor's Office investigators named the Constitutional Court as a suspect in the case of procuring the ship sourced from the 2006 Halsel Regional Budget.
Terjalannya waktu, pada Januari 2009 BPKP perwakilan Maluku, lalu melakukan audit penuhan kerugian negara dan hasilnya tidak ditemukan adanya kerugian keuangan negara, sehingga atas dasar hal tersebut, maka kasusnya dihenti atau SP3 oleh Kejati Malut dan tidak dilanjutkan ke tahap penuntaan.
Against the SP3, the NGO Gamalama Corruption Watch (GCW) then filed a pretrial lawsuit, and for the pretrial lawsuit, the corruption court (Tipikor) at the Ternate Class 1 B District Court (PN) stated that the SP3 of the Attorney General's Office was invalid.
In addition, the court is of the opinion that the institution authorized to conduct a state financial audit is the BPK (Financial Audit Agency), not the BPKP (Financial Audit and Development Agency).
Regarding the pretrial decision, on Wednesday, July 4, 2012, the North Maluku Prosecutor's Office submitted Verzet on the Ternate District Court's decision to the North Maluku High Court on Wednesday, and by the North Maluku High Court in its ruling stated that it could not be accepted.
Furthermore, on Thursday, September 6, 2012, the Head of the North Maluku Attorney General's Office (at that time) issued an investigation warrant and asked the North Maluku Representative BPK to calculate state financial losses in this case.
"So based on the BPK letter representing North Maluku province number: 353/S/XIX/.TER/12/2014 dated December 15, 2014, regarding the report on the results of the calculation of regional losses on the alleged corruption in the purchase of the Fast Halsel Express ship 01 for the 2006 fiscal year to the South Halmahera Regency government number: 66/LHP/XIX.TER/12/2013 dated December 31, 2013, which in conclusion BPK representatives of North Maluku province cannot calculate regional losses," said Ricard.
Based on the report on the results of the regional loss calculation, on Thursday, May 21, 2015, said Richard, the Head of the North Maluku Prosecutor's Office officially stopped the case by issuing SP3. So currently the Constitutional Court is no longer a suspect.
"Based on the order to terminate the investigation (SP3) number: print139/S.2/Fd.1/05/2015 on May 21, 2015, H. Muhammad Kasuba is no longer a suspect," said Richard.
Former Halsel Regent Muhammad Kasuba is the younger brother of former North Maluku Governor Abdul Gani Kasuba who is currently a defendant in the OTT case of the Corruption Eradication Commission (KPK) who will fight in the 2024 North Maluku regional elections paired with Basri Salama which was promoted by the PKS Party coalition and the Hanura Party.
