Antam Gold Corruption Case, Crazy Rich Surabaya Budi Said Charged With State Loss Of IDR 1.1 Trillion
JAKARTA - An entrepreneur who is also known as crazy rich Surabaya, Budi Said, was charged with fabricating the sale and purchase of gold involving PT Antam Tbk with the purchase mode below the official price. This case caused state losses of IDR 1.1 trillion.
This was revealed when the Public Prosecutor (JPU) read out his indictment in the case of alleged corruption in gold management weighing 109 tons at PT Antam which occurred between 2010 and 2022.
The sale and purchase engineering was carried out by the defendant Budi Said together with former General Manager of PT Antam Tbk Abdul Hadi Avicena; Exi Anggraeni as a broker; Endang Kumoro as Head of gold boutique for precious metals in Surabaya 01; Ahmad Purwanto as general trading manufacturing and service senior officer; and Misdianto as the office administration or back office for gold boutique in Surabaya 01, in collaboration to regulate the process of buying and selling gold at prices below the market.
"The defendant Budi Said together with Eksi Anggraeni, Endang Kumoro, Ahmad Purwanto, Misdianto made an Antam gold sale and purchase transaction on the gold boutique of the noble metal in Surabaya 01 under the official price of Antam gold which was not in accordance with the gold price setting procedure from the gold council procedure of PT Antam Tbk," said the prosecutor during a trial at the Jakarta Corruption Court, Tuesday, August 27.
In the purchase, Budi and Eksi Anggraeni received 100 kilograms of Antam gold from Endang Kumoro, Ahmad Purwanto, and Misdianto in the Surabaya 01 bem through a shipment from the Pulogadung precious metal processing and refining business unit (UBPPLM) PT Antam Tbk at a price of Rp 25.2 billion.
Supposedly, with that nominal, Budi Said only got 41,865 kilograms of Antam gold. Thus, getting a difference of more than 58,135 kilograms or worth Rp35,078,291,000 which is not in accordance with the gold sales invoice.
"So that the defendant Budi Said has received a difference of more gold antam weighing 58.135 kg, which has not been paid by the defendant," said the prosecutor.
Then the obligation to lose Antam's gold handover from PT Antam to Budi Said was 1,136 kg based on the decision of the Supreme Court (MA) Number: 1666 K / Pdt / 2022 dated June 29, 2022.
In the sale and purchase process, Eksi Anggraeni noted as a transaction that seems to be at an official price set in accordance with sales procedures from PT Antam.
In addition, Endang Kumoro, Ahmad Purwanto and Misdianto also did not record the actual stock of opname in the gold boutique of precious metal (belm) Surabaya 01 for gold purchase transactions made by Budi Said or on behalf of other buyers
The act seemed to be the same as the real physical stock at the Surabaya 01 belum safe, resulting in a physical lack of Antam gold in the gold boutique of precious metal (belm) Surabaya 01 weighing 152.80 kg.
"That Eksi Anggraeni received a difference of more gold antam weighing 94.665 kg from the number of stocks found by opname, Antam's physical lack of gold weighing 152.80 kg, which in its implementation did not go through the procedures that should have been and through gold receipt transactions that were not in accordance with those recorded in the sales invoice and there was no payment to PT Antam Tbk," he said.
As wages for helping him, Budi Said gave some money to a car to Eksi Anggraeni, Endang Kumoro, Ahmad Purwanto and Misdianto.
"The defendant Budi Said, who obtained the convenience of buying Antam's gold under the official price of PT Antam Tbk so that he received the amount of Antam's gold weight and payments that were not in accordance with the invoices, had given a sum of money to Eksi Anggraeni in the form of a fee of approximately Rp. 92,092,000,000, Ahmad Purwanto of Rp. 500,000,000," said the prosecutor.
"Endang Kumoro in the form of 1 gold chip weighing 50 grams, 1 black Innova car in 2018 with police number B 2930 TZM, Rp 60,000,000 in cash and Misdianto in the form of 1 unit of a white Innova wama car in 2018 with police number N 1273 FG, Rp 515,000,000 and SGD 22,000," continued the prosecutor.
Prosecutors said state financial losses in this case reached Rp1,166,044,097,404 (Rp 1.1 trillion). The financial loss was calculated based on Antam's physical lack of gold in the gold boutique of precious metal in Surabaya 01 and PT Antam's obligation to hand over gold to Budi Said.
"The state financial loss amounted to Antam's physical lack of gold in the Mulia Metal Gold Boutique (BELM) Surabaya 01 as much as 152.80 kg or Rp 92257,257,820 or at least in this amount as reported by the Investigative Audit Results in the context of Calculating State Financial Losses on the management of gold assets in the Mulia Metal Boutique Surabaya 01 PT Antam Tbk in 2018 by the Supreme Audit Agency of the Republic of Indonesia Number: 12/LHP/XXI/09/2021 dated 21 September 2021," said the prosecutor.
"The state financial loss of the amount of the obligation to hand over gold by PT Antam Tbk to the Defendant Budi Said on the Decision of the Supreme Court of the Republic of Indonesia No. 1666K/Pdt/2022 dated June 29, 2022, amounting to 1,136 kg of gold or equivalent to Rp. 1,073,786,839,584," added the prosecutor.
The defendant Budi Said in this case was charged with violating Article 2 paragraph 1 or Article 3 in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 55 in conjunction with Article 64 paragraph 1 1 of the Criminal Code and Article 3 or Article 4 of the Money Laundering Law.
