Exception Of Rizieq Shihab, Lawyer Highlights The Mass Organization Law
JAKARTA - Rizieq Shihab's team of lawyers, Alamsyah Hanafiah said in the objection or exception note that they highlighted the issue of the indictment regarding the Community Organization Act (Ormas) which was included in the case. This is because since the investigation stage there has never been any application of this law.
"Because there is the fifth indictment, there is an article charged with the Mass Organization Law, which was never included in the Sprindik, never in the BAP. Suddenly, when it is transferred to the prosecutor, I don't know where the prosecutor gets the case file, the case file doesn't exist," said Alamsyah to journalists, Friday, March 26.
For that reason, Alamsyah asked the panel of judges to cancel the dakwan from the public prosecutor (JPU).
On the other hand, Rizieq also in his personal exception asked that cases of suspected violation of the health protocol (prokes) be generalized with other cases. The reason is, there are still many cases of crowds that do not go to trial.
"Then Habib Rizieq also conveyed this indictment of crowding. He asked for justice about where events are clustered throughout Indonesia so that they can be used as legal proceedings," said Alamsyah.
"If it is not used as a legal process, he will ask for equal rights before the law so that the indictment is canceled and released. He asks for justice there," he continued.
Furthermore, Alamsyah also mentioned the case of the Megamendung prokes case. In the series of events, Rizieq Shihab was only an invited guest.
"Likewise Megamendung. That was the exception of Rizieq's habib being invited. So in Megamendung he never knew that it was that scary. Only they knew that Rizieq's habib was going there suddenly the road was full," he said.
