There Is No Mediation, The Judge Continues The Trial For A Lawsuit Of Rp. 5.8 Billion. Jhoni Allen To AHY Et Al
JAKARTA - The panel of judges at the Central Jakarta District Court decided to continue the trial process of Jhoni Allen Marbun's lawsuit against Agus Harimurti Yudhoyono (AHY) and a number of high-ranking Democrat Party officials.
The judge continued the trial without mediation because the lawsuit was a political party dispute.
The decision of the panel of judges began when the legal lawyer from Jhoni Allen questioned the agenda in the inaugural trial.
"Permission to ask whether in the process of a civil lawsuit against the law being heard today, are we directly included in the reading of the lawsuit or are we still on the agenda of appointing a mediator, Your Honor?" asked Jhoni Allen's attorney, Slamet Hassan during a trial at the Central Jakarta District Court, Wednesday, March 24.
The panel of judges explained that the lawsuit filed by Jhoni Allen fell into the realm of political party disputes. Therefore, in the regulation there is no mediation stage.
"Because the lawsuit is related to political parties, while in the political party law this lawsuit is the qualification in a political party dispute. So there is no mediation," said the judge.
For that reason, the panel of judges decided that the trial would continue. Thus, the plaintiff read out the petitum.
After the trial, Slamet emphasized that the General Chairperson (Ketum) of the Democrat Party, Agus Harimurti Yudhoyono (AHY), Secretary General of Democrats Teuku Riefky Harsya, and Chairman of the Honorary Council of the Democratic Party, Hinca Pandjaitan, committed acts against the law.
"That the plaintiff filed a quo lawsuit against Defendant I, Defendant II, and Defendant III in connection with the actions or actions of Defendant I, Defendant II, and Defendant III who had unlawfully decided and dismissed the plaintiff as a member of the Democratic Party," said Slamet.
Previously reported, Jhoni Allen also sued Agus Harimurti Yudhoyono (AHY) and his friends for paying compensation of Rp. 5.8 billion. The value of this loss is calculated from the material and immaterial losses from Jhoni's dismissal from the Democratic Party.
"So, the potential material loss is the salary of members of the DPR for about 60 months and a loss of Rp. 5.8 billion. The immaterial loss is the humiliated honor of JA whose political rights are deprived," said Slamet.
