MK Decides On Denny Indrayana's Lawsuit In South Kalimantan Pilgub: Order 7 Sub-Districts Voting
JAKARTA - The Constitutional Court (MK) decided to re-vote (PSU) in seven sub-districts in the Pilgub of South Kalimantan (South Kalimantan).
The decision was read out by the Constitutional Court judge at the court decision regarding the dispute over the results of the general election (PHPU) for the South Kalimantan Pilgub at the Constitutional Court building, Friday, December 19. The lawsuit was filed by Denny Indrayana-Difriadi Darjat.
The seven sub-districts that were decided to hold a re-voting (PSU) were South Banjarmasin District in Banjarmasin City and five sub-districts in Banjar Regency and 24 polling stations (TPS) in Binuang District, Tapin Regency.
The five sub-districts in Banjar Regency that were cut off by the PSU are Connect Makmur District, Aluh-Aluh District, Martapura District, Mataraman District and Astambul District.
Meanwhile, 24 polling stations (TPS) in Binuang Subdistrict, Tapin District, namely TPS 1, 2, 3, 6, 8, T reveal Village, TPS 1, 6, 8, 12, 13, 14, 16, 18, Binuang Village.
Then TPS 5, 7, 10 Desa Raya Belanti, TPS 1, 2, 3, 4, 5 Desa Pualam Sari, TPS 2 Desa Padang Sari and TPS 1 and 3 Desa Mekarsari.
For his decision, the MK judge canceled the South Kalimantan KPU's decision letter in determining the recapitulation of votes for the 2020 South Kalimantan Pilgub elections on 18 December 2020. The KPU in the recapitulation determined the candidate pair Sahbirin Noor and Muhidin to win 8,127 votes from pair number 2, Denny Indrayana and Difriadi Derajat .
The Constitutional Court also granted some of the arguments petitioned by the petitioner, namely candidate pair number 2 in the Pilgub of South Kalimantan, Denny Indrayana and Difriadi Derajat.
Among the arguments for point 5, namely 100 percent voter attendance at 24 polling stations in Binuang District, Tapin Regency, point 6 is the opening of ballot boxes by PPK in South Banjarmasin District, Banjarmasin City and point 7 there is vote mark-up in Banjar Regency.
Meanwhile, the arguments in points 1 to 4 are not accepted under the law, aka rejected by the Constitutional Court. Namely the abuse of COVID-19 water reservoirs for campaigns, the misuse of the tagline "Move" in South Kalimantan Government programs which later became the campaign tagline for related parties.
There is also the misuse of COVID-19 social assistance for related party campaigns as well as money politics which is carried out in a tandem strategy with candidate pairs for regents and deputy regents of Banjar Regency.
The Constitutional Court also decided that the time for re-voting (PSU) was carried out no later than 60 working days from the decision and ordered new KPPS and PPK officers to ensure that the election was based on direct, general, free, secret (overflow) and honest and fair (fair) principles. .
Then the Constitutional Court ordered supervision from the central KPU to the South Kalimantan provincial KPU to level up to districts and cities including Bawaslu who also did the same thing.
The Constitutional Court judge in his decision also asked the Police, in this case the South Kalimantan Regional Police and its staff, to secure the implementation of the PSU so that it runs safely and smoothly.
Chairman of the South Kalimantan Golkar Party Election Winning Board Supian HK representing candidate number 1, Sahbirin Noor and Muhidin stated that they accepted the Constitutional Court's decision and left it entirely up to the people's choice to the PSU later.
