OJK Firmly Investment Management By Unlicensed Persons Is A Violation

JAKARTA - OJK Chief Executive of Capital Market Supervisory, Derivative Finance, and Carbon Exchange (PMDK) Inarno Djajadi emphasized that the management of investment funds by unauthorized individuals is a violation in the capital market sector.

"Management of funds and/or effects in the form of investment management, carried out by unauthorized persons, is a violation of regulations in the capital market sector," said Inarno quoting Antara.

Inarno explained that this had been regulated in Law Number 8 of 1995 concerning the Capital Market as amended by Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector.

In the regulation, it is stated that parties that can manage securities portfolios, collective investment portfolios, and/or other investment portfolios for the benefit of a group of customers or individual customers, except for insurance companies, sharia insurance companies, pension funds, and banks, must have an securities company license as investment manager (MI).

Then regarding the existence of an investment club abroad, Inarno still assesses that according to regulations, collective investment management can only be carried out by the Investment Manager.

For information, the investment club or investment club is a group of people who put money into a joint fund which is then invested in the common interest of group members.

Furthermore, OJK is currently reviewing related classification, development and strengthening of investment manager institutions, including its business activities.

In this case, said Inarno, investment managers conduct investment management for managed funds within certain limits or management for the benefit of high networth/professional investors, there are requirements and classifications related to this.

Based on the P2SK Law, in the future there will be other parties who can manage funds called Trustee Fund Management (PDP) or trustee.

The aim is, among other things, for inheritance planning and investment management. PDP accepts the transfer of assets from asset owners in the context of asset management for interests. PDP Beneficiary Owners can be in the form of legal entities or individuals.
