The Chaos Of Mother Kandung's Criminal Child On Heritage: Yuridis Still Recorded
JAKARTA - Kusu Botasi, a mother who is policed by her biological child regarding inheritance, emphasized that she has never changed the heir certificate or SKW which is a problem.
It is known that Kusu Cetaki was reported by Stefani Sugianto on suspicion of falsifying his deed to the West Java Regional Police. In fact, the case has entered the trial stage.
Kusu Utaki's attorney, Nyana Wangsa, said that in the SKW, all children of her client were still listed as heirs.
"Mrs. Kusu putri gave it up and asked for the notary to make it without the signature of Kusu Lutaki and his children but there are still the names of the heirs," Nyana Wangsa told reporters, Saturday, June 30.
Kusu's application to the notary in making the SKW was not intended not to involve Stefani Sugianto in the distribution of inheritance assets.
However, the previous heir certificate did not apply. Because, at that time the letter he had was only the knowledge of the village head or the local sub-district.
In fact, in Article 1868 of the Civil Code, Indonesian citizens of Chinese descent must make a certificate of inheritance through a notary.
"This notary states that this letter does not apply because Kusu Botaki's mother is an Indonesian citizen, Ketururahan Chinese must be made in a notary about heirs," he said.
In addition, the facts revealed in the trial that Stefani Sugianto's name was still listed as the heir. In the letter made in front of the village head, village head, or notary.
"The facts of the trial, asked by the judge, ma'am. Why did you report your mother on the pretext that her inheritance rights were removed even though she was juridically listed as an heir in the notary," he said.
On the other hand, Nyana Wangsa also said that her client had tried to resolve the problem peacefully. However, Stefani asked for a share of Rp500 billion.
However, during the negotiation process, Stefani Sugianto's camp still asked for a fantastic value of IDR 10 billion and 50 kilograms of gold.
"When restorative justice at the regional police and at the National Police Headquarters, there were certain intrigues, he had asked for parts that were beyond logic," said Nyana.
In fact, in the trial Stefani Sugianto had said that he never wanted to or asked to be born from the womb of Kusu Botasi, which is his biological mother.
"Until yesterday at the district court he said in front of the judge, asked by Mrs. Ika, it is true that Mrs. had said that she did not ask to be born from Kusu Utaki's mother, she replied firmly 'yes, I didn't ask to be born from Kusu Botari's mother', it was extraordinary," said Nyana Wangsa.

In fact, if Stefani Sugianto did not sign the certificate, he would not be considered the heir.
"Now say my signature is forged, but if it is not signed, taki will not be one of the heirs. This is not detrimental to Stefani, what is this certificate that harms Stefani? Because here he remains the heir," said Ika asserted.
