Following Up On The Supreme Court's Decision, KPU Calls The Age Limit For Cagub-Cawagub At Least 30 Years Valid January 1, 2025

The General Election Commission (KPU) is following up on the decision of the Supreme Court (MA) regarding changes in the age limit for regional head candidates. In its decision, the Supreme Court has determined that the candidates for governor-deputy governors are at least 30 years old, as well as candidates for regent-deputy regents and mayors-deputy mayors are at least 25 years old starting from the inauguration of the elected candidate pairs.

Chairman of the Indonesian KPU Hasyim Asy'ari said that the interpretation of the age limit for cagub-cawagub was 30, as well as cabup-cawabup and cawalkot-cawawalkot was 25 by January 1, 2025.

"It is concluded that the full age requirements of the candidate must be 25 years old for candidates for regent/mayor and deputy regent/deputy mayor, and must be 30 years old for candidates for governor and deputy governor, on January 1, 2025," said Hasyim in his statement, Sunday, June 30.

Hasyim explained, in the Pilkada Law, the inauguration of the regional head candidate pair was carried out simultaneously. Simultaneous inauguration is carried out at the end of the term of office of the regional head for the last period.

Thus, the simultaneous inauguration will be held after the term of office of the definitive regional head who serves in the 2020 Pilkada ends.

"Finally, the term of office of the candidate pair for regional head and deputy regional head resulting from the last election (Pilkada 2020) is interpreted at the end of 2024, namely December 31, 2024. As a legal consequence of the numbers 1 and 2, simultaneous inauguration must be scheduled for January 1, 2025," said Hasyim.

Meanwhile, Hasyim said that the schedule and procedures for simultaneous inauguration were regulated by Presidential regulations.

For information, the Supreme Court granted the request of the General Chairperson of the Garuda Party, Ahmad Ridha Sabana, who submitted a judicial review regarding the age limit for regional heads of at least 30 years to be revoked.

The decision was decided by the Chief Justice Yulius, with members of the Panel of Judges 1 Bright Bangun and Member of the Panel of Judges 2 Yodi Martono.

In its decision, the Supreme Court stated that the minimum age limit for Cagub and Cawagub as stated in Article 4 Paragraph (1) letter d of PKPU Number 9 of 2020 contradicts Law (UU) Number 10 of 2016 concerning Pilkada.

Previously, Article 4 Paragraph (1) letter d of PKPU 9/2020 reads, "The lowest age is 30 years for Candidates for Governor and Deputy Governor and 25 years for Candidates for Regent and Deputy Regent or Candidate Mayor and Deputy Mayor since the inauguration of the elected Candidate pair".

The Supreme Court then turned it into, at least 30 years old for Candidates for Governor and Deputy Governor and 25 for Candidates for Regent and Deputy Regent or Candidate Mayor and Deputy Mayor since the inauguration of the elected Candidate pair.

The Supreme Court also ordered the KPU to revoke Article 4 Paragraph (1) letter d of PKPU Number 9 concerning the Candidacy for the Election of Governors and Deputy Governors, Regents and Deputy Regents, and/or Mayors and Deputy Mayors.
