Corruption Rp 36 Billion, Former Head Of Kayangan Port Sentenced To 14 Years In Prison

The Panel of Judges at the Corruption Court (Tipikor) at the Mataram District Court, West Nusa Tenggara, sentenced him to 14 years in prison for the former Head of the Class III Kayang Port Organizing Unit, Sentot Ismudiyanto Kuncoro.

Spokesperson for the Mataram District Court Kelik Trimargo in Mataram, Tuesday, said that the panel of judges sentenced the defendant to be proven to have committed a criminal act of corruption together as in the first indictment of the public prosecutor.

"Therefore, the defendant's actions as Head of the Class III Kayang Port Organizing Unit were found guilty of violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code," said Kelik as quoted by ANTARA.

In addition to punishment, the panel with the presiding judge Isrin Surya Kurniasih consisted of career judge Lalu Moh. Sandi Iramaya and Adhoc Judge Irawan Ismail also imposed a fine of Rp. 500 million, subsidiary to 4 months in prison.

"In the verdict, the judge also determined that the detention period that the defendant had served was reduced entirely from the sentence imposed and determined that the defendant was still detained," he said.

Based on the verdict read out by the panel of judges on Monday (11/6), the defendant and public prosecutor have not yet stated their stance on accepting or submitting further legal action to the West Nusa Tenggara High Court.

The sentence against Sentot is lower than the prosecutor's demand for a judge to impose 16 years in prison. Meanwhile, the fines and charges imposed are still the same as the demands.

In the defendant's decision, the judge also stated something similar to the prosecutor's demand that Sentot as the harbormaster had issued a sailing approval letter (SPB) for the shipment of mining materials of PT Anugrah Mitra Graha (AMG) which had not yet obtained approval for the planned activity and budget (RKAB) from the Ministry of Energy and Mineral Resources (ESDM) RI.

According to the prosecutor, if the defendant upholds his commitment as a martyr, then there will be no state financial loss of Rp36.4 billion from the results of the shipment of mining materials of PT AMG without the ministry's permit for the period 2021-2022.
