Sentenced To 7 Years In Prison At The Appeal Level, Former Head Of Mineral And Coal ESDM NTB Files Cassation In The Iron Sand Corruption Case

NTB - Former Head of Mineral and Coal (Minerba) Division of the Department of Energy and Mineral Resources (ESDM) of West Nusa Tenggara (NTB) Syamsul Ma'rif who was sentenced to 7 years in prison at the appeal level filed an appeal to the Supreme Court (MA).

Syamsul Ma'rif became one of the defendants in the corruption of the PT Anugrah Mitra Graha (AMG) iron sand mine in 2021-2022 in the Dedalpak Block, East Lombok Regency.

"Yes, on behalf of Samsul Ma'rif, we have declared an appeal against the appeal decision at the NTB High Court. The submission has been registered at the Mataram District Court," said Mataram District Court spokesman Kelik Trimargo in Mataram, Wednesday, May 22, confiscated by Antara.

In the Case Investigation Information System (SIPP) of the Mataram District Court, Syamsul Ma'rif registered a statement filing an appeal to the Supreme Court on Monday, May 20.

In the decision of the NTB High Court (PT), the panel of judges at the appeal level chaired by I Wayan Wirjana changed the court's decision at the first level just regarding the length of imprisonment, the number of fines, imprisonment for fines imposed on the defendant, and evidence.

With this decision, the judge at the appeal level sentenced him to seven years in prison and a fine of Rp. 300 million, subsidiary to three months in prison to replace the fine.

This appeal rate decision is higher than the first-degree court decision which sentenced Syamsul Ma'rif to imprisonment for 5 years with a fine of Rp. 200 million, a subsidiary of two months in prison to replace the fine.

In this case, Syamsul Ma'rif together with two former Heads of the NTB ESDM Service, Zainal Abidin and Muhammad Husni, acted as the people who helped launch the delivery and sale process of PT AMG's mining production in the Dedalpak block in East Lombok Regency.

The defendants were proven to have helped PT AMG by issuing a statement and statement letter on behalf of the Head of the NTB ESDM Service as a substitute for the planned budget activity (RKAB) which has not received approval from the Indonesian Ministry of Energy and Mineral Resources.

As a result of mining activities without RKAB running in 2021-2022, there was a state financial loss resulting from the NTB BPKP audit worth Rp36.4 billion.
