6 Types Of Dowry Prohibited In Islam, Marriage Is Considered Illegal
YOGYAKARTA - Maskah or dowry is one of the requirements for marriage in Islamic teachings. Men's mink gives dowry to the bride and groom during the marriage contract procession. This recommendation is contained in the Qur'an'an letter An Nisa Paragraph 4.
Let's talk about it. Let's talk about it, let's talk about it.
Meaning: "Give the dowry (mahar) to the woman (whom you marry) as a gift voluntarily. Then if they hand over to you some of the dowry with pleasure, then watch it (take) the gift (as food) which is delicious again well as a result".
The function of dowry in marriage is described in the Qur'an and hadith, which is a form of appreciation and respect for the woman being proposed. This dowry is also a form of responsibility for the groom to live with her choice of women.
If the prospective husband does not give up the dowry, the marriage becomes invalid. The dowry that can be given by the male party can be in the form of goods and money. However, most of the groom gives a dowry in the form of gold. In addition, there are several types of dowry that are prohibited in Islam.
Before undergoing the wedding procession, a man must prepare a dowry first. The choice of the form of a dowry is also not allowed arbitrarily or carelessly. There are several dowrys that must be avoided because it is not allowed in Islamic teachings.
In the book Bidayatul Mujtahid Wa Nihayatul Muqtashid Volume 2: Complete Reference for the Comparison of Madzhab by Ibnu Rusyd which was translated by Al MAsudah, mentioned several types of dowries forbidden in Islam as follows:
The dowry of prohibited objects in question is gifts in the form of khamr (ILement), pork, immature fruits, or loose camels. If the dowry consists of these things, the valid or not of the contract can be debated.
As Imam Abu Hanifah believes that the contract remains valid even though there is a mitsil dowry. However, Imam Malik argues otherwise that the contract will be damaged and canceled if you use these forms of dowry, either for wives who have been awarded or not.
Giving a dowry in which there is an element of trade or buying and selling is also considered invalid for marriage. For example, in the case when the wife handed over the male slave to her husband and her husband paid a thousand dirhams as a dowry for the wife, but the payment also included the price for the slave.
Imam Syafi'i stated that a wife can ask for compensation if her dowry is flawed, although she also believes that the wife can ask for a dowry. The opinion of the Maliki mazhab states that the wife can ask for a dowry in the form of a similar item.
In this context, if a man marries a woman and stipulates the condition that in his dowry there must be a gift for the father of the woman. This form of dowry seems like a representative in a sale and purchase transaction that sells goods and stipulates the conditions for giving for his profits. Therefore, such marriages should not be carried out.
Aggravating dowry is also not recommended in Islamic teachings. According to the Smart Book of Women's Fiqh by Abdul Qadir Manshur, the dowry is not actually the main goal of marriage. But only as a symbol of the bond of love and affection
Marriage with a light dowry is actually considered to be able to bring blessings in domestic life. As mentioned in the hadith narrated by Aisyah, Rasulullah SAW stated, "The most blessed marriage is the least cost." (HR Ahmad)
Even though aggravating dowry is prohibited in Islam, marriage dowries that do not have value are also included in the category of unallowed dowry. According to Ummu Azzam's book Walimah Cinta, Islam provides concessions to men who are unable to provide dowries with a high nominal value according to the request of a future wife, by paying in installments or disbursing payments.
The dowry permitted in Islam is a dowry that has value, such as gold, a set of prayer tools, or items that are beneficial for the life of a bride-to-be.
Those are some of the dowries that are prohibited in Islam from being used as marriage dowry.
Avoid choosing the forms of the dowry above if you don't want marriage to be considered invalid.
