Response To The Constitutional Court's Decision, Ganjar Highlights Opinion Dissenting 3 Judges

Presidential candidate number 3, Ganjar Pranowo said that there were three constitutional judges who expressed dissenting opinions. Namely, Saldi Isra, Enny Nurbaningsih, and Arief Hidayat. The different opinions of the three judges of the Constitutional Court (MK) are said to be interesting in the trial of the 2024 Presidential Election dispute (Pilpres).

According to him, constitutional judges do not only talk about figures in dispute over election results. However, it is more substantive.

"What is interesting in our notes is that the dissenting was conveyed that the exception exception was rejected. The judge will try, the judge will not only talk about a calculator, he will speak substantively," said Ganjar to reporters at the Constitutional Court, Monday, April 22.

In fact, he said, Judge Arief Hidayat in his dissenting opinion granted the lawsuit from his camp and Anies-Cak Imin.

This means that the judge has room or freedom to determine his decision. Although, overall the lawsuit of the two applicants was rejected.

"Even earlier, Mr. Arief granted it, so it means that the judge's conscience has its own space to express it in the form of a decision and I think this is a long process that we must respect," said Ganjar.

The Constitutional Court has decided to reject the Ganjar-Mahud camp's petition regarding the Dispute over the General Election Results (PHPU) of the President and Vice President 2024.

"Reject the applicant's application in its entirety," said Chief Justice of the Constitutional Court Suhartoyo.

In this decision, there are three constitutional judges who state dissenting opinions. Namely, Saldi Isra, Enny Nurbaningsih, and Arief Hidayat.

Originally, the Ganjar-Mahfud camp submitted a request for the Constitutional Court to disqualify candidate pair number two, namely, Parbowo-Gibran to be qualified.

There are several arguments in the petition submitted, such as allegations of ethical violations during the 2024 presidential election. Then, President Joko Widodo's nepotism action was carried out.

Allegations regarding the occurrence of coordinated abuse of power in all lines of government, and alleged violations of election procedures that occurred before the voting process that occurred in SIREKAP.
