The Constitutional Court Will Accept The Conclusion Of The Presidential Election Dispute Session On Tuesday

JAKARTA - The Constitutional Court (MK) will accept the conclusion of the 2024 presidential election dispute or dispute trial (PHPU) tomorrow, Tuesday (16/4).

"The conclusion is submitted to the Constitutional Court through officers in the secretariat," said Head of the Legal Bureau of Administration and Administrative Affairs of the Constitutional Court Fajar Laksono when contacted by ANTARA in Jakarta, Monday.

Fajar said the conclusion of the trial should be submitted by all parties involved in the presidential election dispute. In this case, the legal team of the Anies Baswedan-Muhaimin Iskandar pair as the applicant one and Ganjar Pranowo-Mahfud Md as the applicant two.

Then, the Indonesian KPU as the respondent; Defenders Team Prabowo Subianto-Gibran Rakabuming Raka as the related party; and Bawaslu. This conclusion will be the last bullet for the parties in this presidential election dispute.

"It should be yes (handed over by all parties) because this conclusion is in the interest of the parties to support standing (positions), arguments, and their respective petitums," he said.

In addition, Fajar emphasized that the reading of the 2024 presidential election PHPU decision is scheduled to be held on Monday, April 22, 2024.

Previously, the constitutional judge and spokesman for the Constitutional Court, Enny Nurbaningsih, said that the Hakim Consultative Meeting (RPH) for the 2024 Presidential Election PHPU would be held formally starting April 16, 2024.

The date coincides with the deadline for submitting conclusions by the parties in the case. "The formal RPH starts on weekdays April 16 after receiving the conclusion," said Enny when contacted in Jakarta, Monday (8/4).

Enny explained that since Saturday (6/4) the constitutional judges conducted a thorough investigation of the results of the trial which had been held from 27 March to 5 April 2024.

"Since Saturday (6/4), each judge has investigated all the results of the trial for the sake of drafting a legal opinion of the judge and there are judges meeting to prepare for the Legislative Election PHPU," he said.

In the PHPU for the 2024 presidential election, the Anies-Muhaimin pair basically asked the Constitutional Court to cancel the KPU Decree Number 360 of 2024 concerning the Determination of the Results of the 2024 Presidential and Vice Presidential General Elections.

Anies-Muhaimin also asked the Constitutional Court to disqualify the Candidate Pair for President and Vice President of the Republic of Indonesia Prabowo Subianto-Gibran Rakabuming Raka as participants in the 2024 presidential election. Both of them also asked the Constitutional Court to order the KPU to re-vote for the 2024 presidential election without including Prabowo-Gibran.

Meanwhile, the Ganjar-Mahfud pair asked the Constitutional Court to cancel the KPU Decree Number 360 of 2024 concerning the Determination of the General Election Results of the President and Vice President in 2024.

They also asked the Constitutional Court to disqualify Prabowo-Subianto as the pair of candidates for the 2024 presidential election. Then, asking the Constitutional Court to order the KPU to re-vote for the 2024 presidential election only between Anies-Muhaimin and Ganjar-Mahfud.
