BCA Clarifies Incorrect Transfer Of Rp. 51 Million. The Defendant Has No Good Will For One Year Of Mediation

SURABAYA - Executive Vice President of Secretariat & Corporate Communication of BCA, Hera F Haryn, said that the settlement of the case of wrongly transferring Rp. 51 million to Ardi Pratama's account was a year-long dead end. The reason is there is no good faith from Ardi Pratama.

"Actually, this case has been going on for more than a year. Due to Ardi Pratama's lack of goodwill, the case was finally upgraded to a police report," said Hera, confirmed, Tuesday, March 2.

Hera emphasized that BCA tried to resolve the case before it was finally processed by law. This settlement was carried out through an approach with Ardi including mediation through the police. But all failed, without finding a bright spot.

Therefore, continued Hera, BCA sent two notification letters to Ardi. The contents stated that there had been a wrong transfer, and asked the customer to return the funds since March 2020.

In addition to the summons, Nk (a former BCA employee), who was still on duty at BCA Citraland, tried to approach the customer to encourage them to immediately resolve this problem.

"The problem solving turned out to be protracted, because the customer did not show good faith, even though mediation had been carried out with the police," he said.

Because there was no bright spot, continued Hera, NK took the initiative to bring the case to the realm of law. Hera emphasized that the wrong transfer case had nothing to do with BCA, considering that Ardi was reported to the police by a former BCA employee, not by the bank.

"So, the report was the wish of a former employee (not the BCA party)," said Hera.

The legal process is based on Article 85 of Law No.3 / 2011, which reads that any person who deliberately controls, and recognizes as his property the transferred funds which are known, or should be known, are not his right, then shall be sentenced to a maximum imprisonment of five years or a maximum fine. IDR 5 billion.

"That the case is currently in legal proceedings, and BCA still respects the ongoing legal process. BCA as a banking institution has carried out banking operations in accordance with applicable legal provisions," said Hera.
