Former Head Of PUPR Papua Demanded 7 Years In Prison Plus Replacement Money Of IDR 4.5 Billion
JAKARTA - Former Head of the Papua Public Works and Spatial Planning Agency (Kadis PUPR), Gerius One Yoman, was sentenced to 7 years in prison and a fine of IDR 350 million, subsidiary to 4 months in the case of gratification in project procurement within the Papua Provincial Government.
"Sentenced the defendant to seven years in prison and a fine of Rp. 350 million, subsidiary to imprisonment for four months," said the Public Prosecutor of the Corruption Eradication Commission (KPK) in a trial at the Corruption Court, Jakarta, as reported by ANTARA, Monday, March 4.
In addition, Gerius One Yoman was also required to pay a replacement fee of Rp. 4,595,507,228 no later than 1 month after the final legal decision. If not paid, then his property can be confiscated by the prosecutor and auctioned off to cover the replacement money.
"In the event that the defendant does not have sufficient assets to pay the replacement money, he will be sentenced to three years in prison," said the prosecutor.
The prosecutor stated that the defendant Gerius One Yoman had been legally and convincingly proven guilty of committing a criminal act of corruption as in the cumulative indictment.
In this case, the prosecutor said that the person concerned was proven to have received gratuities from a number of parties with a total of Rp5,765,507,228.
The gratuities received, said the prosecutor, were fees in the form of money and renovations and procurement of the completeness of official houses worth Rp2,595,507,228 from Rijatono Lakka as Director of PT Tabi Anugerah Pharmindo, PT Tabi Bangun Papua as well as CV Walibhu.
Then, an apartment unit in Central Jakarta worth Rp1,170,000,000 from Piton Enumbi as the Director and Owner of PT Melonesia Mulia, PT Lingge-Lingge, PT Astrad Jaya and PT Melonesia Cahaya Timur.
Next, Rp2,000,000,000 from Samuel Sometimes as a contractor or entrepreneur who works on a project or work to improve the Kuprik-Jagebob-Erambu road in 2021.
In imposing demands, the prosecutor considered burdensome things, namely Gerius' actions did not support the government's program in realizing the government and democracy of a country that was clean and free from corruption, collusion and nepotism, and that the defendant was convoluted, making it difficult to prove.
"Things that are mitigating: the defendant has never been convicted; the defendant has family responsibilities," continued the prosecutor.
In this case, Gerius was charged with receiving gratuities worth a total of Rp2,595,507,228.00. The acceptance was to mobilize the defendant and former Papua Governor Lukas Enembe to provide a project or work for the procurement of goods and services at the Papua PUPR Service in the 2018-2022 fiscal year to Rijatono Lakka.
In addition, he was also charged with receiving gratuities of Rp. 2 billion and apartments in Central Jakarta worth Rp. 1.1 billion.
