Aiman Witjaksono's Lawyer Confirms The Confiscation Of Cellphones To Instagram Accounts Carried Out By The Legally Defected Police

JAKARTA - The legal team Aiman Witjaksono said that the confiscation of cell phones, social media, and emails by investigators from the Special Criminal Investigation Directorate of the Metro Jaya Police was legally flawed.

"The confiscation permit must be signed by the Chairman of the District Court, not the Deputy Chair of the District Court," said Head of the Judicial Team Aiman Witjaksono, Finsensius Mendrofa, as reported by ANTARA, Monday, February 19.

According to him, the confiscation letter issued by the South Jakarta District Court (PN Jaksel) which became the basis for the confiscation of Aiman Witjaksono's cell phone was not in accordance with applicable law.

Mendrofa said that the head of the South Jakarta District Court should have signed the letter, not the Deputy Chair of the South Jakarta District Court, especially in the confiscation letter, also did not include the Deputy Chairperson of the South Jakarta District Court as acting or acting.

For this reason, said Mendrofa, his party submitted a pretrial to the South Jakarta District Court, so that what had been confiscated by the police could be returned.

"The confiscation by the respondent (Investigator of the Directorate of Special Criminal Investigation of the Metro Jaya Police) is formally flawed," he said.

Previously, the South Jakarta District Court heard a pretrial filed by the National Winning Spokesperson (TPN) Ganjar-Mahfud MD, Aiman Witjaksono regarding the confiscation of social media and email accounts by investigators from the Directorate of Special Criminal Investigation of the Metro Jaya Police.

"To the respondent and the applicant, because of the limited time in this trial for seven days. Let's make a calendar of trial plans," said South Jakarta District Court Tunggal Judge Delta Tama.

For this reason, said Delta, it must be agreed that the proceedings will be held and begin with reading the petition on Monday.

Then continued Delta, the respondent's answer will be read out on Tuesday (20/2), a day later on Wednesday (21/2) followed by a reading of the replica and duplication.

"The evidence will be made on Thursday. Friday in conclusion and Tuesday the verdict," he said.
