The Sentence Of The Former Regent Of Kapuas Added To 6 Years In Prison

PALANGKA RAYA- The sentence of former Kapuas Regent Ben Brahim S Bahat who was charged with corruption has increased by one year in prison from the previous five years in prison.

The reading of the appeal-level decision was led by Marsudin Nainggolan as the presiding judge. Meanwhile, the member judges consisted of Agung Iswanto and Lily Solichul Mukminah and the verdict was read alternately by the judges.

"Sentenced the defendant Ben Brahim S Bahat to six years in prison and a sentence of four years in prison for the defendant Ary Egahni," said Marsudin Nainggolan, during a trial at the Palangka Raya High Court, reported by ANTARA, Thursday, January 25.

The Panel of Judges at the Palangka Raya High Court in addition to imposing prison sentences also sentenced Ben Brahim and Ary Eghani to a fine of Rp. 500 million each, with a subsidiary imprisonment of three months.

Furthermore, the panel of judges also sentenced the state to an additional replacement fee for Ben Brahim of more than Rp. 6.5 billion.

Meanwhile, Ary Egahni was charged with a replacement fee of more than Rp. 2.4 billion, minus the value of assets that had been confiscated of more than Rp. 2.7 billion.

"Meanwhile, the remaining Rp241 million was used to increase the cost of replacement money for the defendant Ben Brahim. The replacement money payment is no later than one month after the court's decision has permanent legal force," he explained.

If within one month after the court's decision to obtain permanent legal force, Ben Brahim has not paid the replacement money, then his property will be confiscated by the prosecutor and auctioned off to cover the lack of replacement money.

In the case that the two defendants do not have sufficient assets to pay the replacement money, they will be sentenced to imprisonment for two years.

The Palangka Raya High Court Panel of Judges also sentenced Ben Brahim and his wife Ary Egahni to revocation of the right to be elected in public office for five years, after both were released from prison terms.

Previously, the KPK Public Prosecutor (JPU) and the two defendants through their legal advisors filed an appeal deed against the decision of the Panel of Judges at the Corruption Court, Palangka Raya District Court.

The KPK prosecutor's team submitted an appeal, on Monday, December 18, 2023. On the following day, Tuesday, December 19, 2023, it was the turn of the two defendants to appeal through their legal advisers.

Previously, the Palangka Raya District Court Panel of Judges sentenced Ben Brahim and his wife to guilt on charges of corruption and gratification within the Kapuas Regency Government.
