BPJS Contribution Increase Canceled, How Much Money Has Been Paid?
JAKARTA - The Supreme Court (MA) in its decision officially canceled the increase in BPJS contributions as of January 1, 2020, which had been signed by President Joko Widodo (Jokowi). The decision was knocked on February 27. Then, what will happen to the premiums that have been paid by BPJS Kesehatan participants as of January 1, 2020?
Member of Commission IX Saleh Daulay said that the fate of BPJS Health premiums, which had increased and been paid in January and February, was determined by the Supreme Court's ruling. If the Supreme Court also decides on a refund, it must also be returned to the participant.
"We will read the decision first, whether it says cancel starting from January or only the following month. If it is canceled starting from January, then we ask the government to return what has been paid," he said, contacted by VOI, in Jakarta, Tuesday, March 10.
When confirmed, the Head of Public Relations of the Supreme Court (MA) Abdullah said the Supreme Court's decision did not mention the return of BPJS Health contributions that had been deposited in January and February.
"Yes, no. That came into effect after this decision was issued. So we didn't talk about the previous month," Abdullah said, when contacted.
If you refer to Abdullah's statement, then BPJS Kesehatan contributions that have increased in the two months before the Supreme Court's decision cannot be returned. Because, in its decision, the Supreme Court only accepted and granted a part of the judicial review submitted by the Indonesian Dialysis Patient Community (KPCDI) against Presidential Regulation Number 75 of 2019 concerning Health Insurance.
In its decision, the Supreme Court stated that Article 34 Paragraph 1 and 2 of Presidential Regulation Number 75 of 2019 concerning Health Insurance does not have binding legal force. In addition, this article was also declared to be contrary to a number of laws (UU).
Through this decision, the Supreme Court annulled the BPJS Kesehatan dues that had been implemented since January 1, 2020 through the Presidential Decree. Previously, the regulation regulated the increase in fees for all segments of the participants.
The increase in BPJS Health outcomes has been in effect since President Jokowi signed Presidential Decree Number 75 of 2019 concerning Amendments to Presidential Regulation Number 82 of 2018 concerning Health Insurance.
(1) Contribution for PBPU Participants and BP Participants shall be:
a. IDR 42,000.00 (forty-two thousand rupiahs) per person per month with service benefits in Class III treatment rooms.
b. Rp110,000.00 (one hundred and ten thousand rupiahs) per person per month with service benefits in Class II treatment rooms; or
c. Rp160,000.00 (one hundred and sixty thousand rupiah) per person per month with service benefits in Class I treatment rooms.
(2) The amount of the Contribution as referred to in paragraph (1) shall come into effect on January 1, 2O2O.
With the cancellation of the article above, BPJS contributions will return to their original contributions, namely:
a. IDR 25,500 for class 3
b. IDR 51 thousand for class 2
c. IDR 80 thousand for class 1
