A Dead End To The Berkarya Reconciliation Process
JAKARTA - Hutomo Mandala Putra alias Tommy Soeharto won the lawsuit against the Minister of Law and Human Rights (Menkumham) Yasonna Laoly at the Jakarta State Administrative Court (PTUN). Tommy sued the Berkarya Party's Kemenkumham Decree which appointed Muchdi Purwopranjono (Muchdi Pr) as party leader.
Decision Number 182 / G / 2020 / PTUN.JKT was knocked on Tuesday, February 16, granted the lawsuit filed by Tommy Soeharto as a representative of the Berkarya Party Central Leadership Council while the defendant was Menkumham.
"Judging in the main case; to grant the lawsuit in its entirety, ”said the verdict of the Jakarta State Administrative Court quoted in the Directory of the Supreme Court, Wednesday, February 17.
In its decision, the PTUN panel declared the cancellation of the Decree of the Minister of Law and Human Rights Number M.HH-16.01 Year 2020 concerning Ratification of Amendments to the Party's Articles of Association and Bylaws dated 30 July 2020 and Decree of the Menkum HAM Number M.HH-17.AH.11.01 Year 2020 concerning Ratification of Changes in the Composition of the Working Party Central Executive Board for the period 2020-2025 dated July 30, 2020.
Responding to this decision, the Chairman of the Berkarya Party Muchdi Purwopranjono (Muchdi Pr) will appeal the decision of the Jakarta State Administrative Court (PTUN).
"By granting the plaintiff's lawsuit against the two RI Kemenkumham Decrees, we will continue to pursue legal action by filing an appeal against the State Administrative Court's decision," Muchdi said via video statement.
This appeal was filed because the process that was being carried out, starting from the preparation of the Extraordinary National Conference (Munaslub), which was carried out from 10-12 July 2020, has been carried out based on the Rules of Association and Bylaws (AD / ART) of the Berkarya Party and applicable laws. .
With this appeal decision, Muchdi Pr asked all party cadres and administrators at all levels to remain solid and run as usual until a decision has permanent legal force or inkhracht.
In addition, Kemenkumham Decrees Number 16 and 17 dated July 30, he said, are still valid and valid until this legal remedy is completed.
Muchdi Pr's desire to file an appeal was then responded to by the Secretary General of the Rich Party from Tommy Soeharto's camp, Priyo Budi Santoso. He asked Muchdi if he wanted to file an appeal.
"Please, go ahead if Mr. Muchdi will appeal," he said in a written statement to reporters, Thursday, February 18.
This former member of the DPR RI believes that Menkumham Yasonna Laoly will see the lawsuit verdict which has canceled Muchdi Pr's leadership. Priyo also said that this decision meant returning the Berkarya Party to the party entitled to lead.
"This decision returns the Berkarya Party to its rightful party. We believe that the Minister of Law and Human Rights, Yasonna Laoly, is ultimately pleased to see the PTUN's decision comprehensively, fairly, and wisely in the framework of law enforcement and a sense of justice," said Priyo.
Furthermore, he also conveyed a message from Tommy Soeharto to his cadres. He said that President Soeharto's son wanted his cadres to work hand in hand to carry out reconciliation within the party.
"General Chairman Mas Tommy Soeharto advised the whole family of the Berkarya Party that it is time to work hand in hand, we will carry out reconciliation together," he said.
Could this reconciliation occur between Tommy Soeharto's camp and Muchdi Pr?
Director of the Indonesia Political Review (IPR), Ujang Komarudin, assessed that reconciliation between these two camps is impossible. Moreover, Muchdi already has a plan to appeal.
"There is probably no reconciliation between the two parties," he said when contacted by VOI.
Ujang assessed that the judicial and appellate mechanisms could reverse the situation in the future so that this problem could become even more acute.
"It is still possible for Muchdi Pr to reverse the situation," he said.
However, this problem should be resolved internally. This is because the struggle that occurs can make internal conditions unfavorable. "And it's not normal to run a party organization," he concluded.
