Corruption Procurement Of Fishing Boats, Head Of The Fakfak Marine Fisheries Service Arrested
MANOKWARI - The District Attorney for Fakfak, West Papua has detained the Head of the local Fisheries and Marine Service with the initials ECDS and a private party with the initials MNN for being involved in corruption in the procurement project for fiber boats of 40 PK and a 50 PK outboard engine for the 2022 fiscal year which cost the state finances Rp169.823 million.
Head of the Fakfak District Attorney's Office Nixon Nikolaus Nilla said the two suspects had been detained since Wednesday (29/11) at the Class II B Prison in Fakfak.
"The Investigative Prosecutor at the Fakfak District Attorney has detained the suspects at the Class IIB Fakfak Prison due to circumstances that raise concerns that the suspects will run away, destroy or destroy evidence, and or repeat criminal acts," said Nixon, Thursday, November 30.
He explained that in 2022 the Department of Fisheries and Marine Affairs Fakfak will receive a budget allocation of IDR 24.320 billion for the procurement of various projects.
From that value, the budget sourced from the Special Autonomy Fund (Otsus) managed by the Fakfak Fisheries and Marine Service is IDR 3,648 for the procurement of fishery facilities and infrastructure.
In practice, the service provider is said to carry out work packages in a direct procurement manner and break up jobs to avoid tenders.
One of the work packages provided at that time was the procurement of a fiber 40 PK cash boat and a 50 PK outboard engine as much as one unit. The work was handled by CV Mahhi Were Phona with a work value of Rp. 191.375 million based on Work Order (SPK) Number 510.2/82/SPK/APBD/DPK/OTSUS/IX/2022 with a period of 80 days.
However, until the end of the contract period on December 17, 2022, the provider was unable to carry out and hand over the goods to the Fakfak Fisheries and Marine Service.
Surprisingly, the Budget User Authority, Commitment Making Officers (PPK) and Treasurers of goods continue to disburse the work package one hundred percent according to the value stated in the contract.
Regarding this case, the Attorney General's Office for Fakfak has examined nine witnesses and collected a number of other evidences.
For his actions, the ECDS and MNN suspects were charged with multiple charges, namely Article 2 paragraph (1) in conjunction with Article 18 letters a and b, paragraph (2) and paragraph (3) of Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code (primers) and Article 3 in conjunction with Article 18 paragraph (1) letters a and b, paragraph (2) and paragraph (3) of Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption O. Article 55 Paragraph (1) 1st of the Criminal Code.

In addition, the two suspects were also charged with Article 8 in conjunction with Article 18 paragraph (1) letters a and b, paragraph (2) and paragraph (3) of Law Number 31 of 1999 as amended and supplemented by Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
Nixon added that based on the results of the calculation of state financial losses by experts in calculating state financial losses, it was found that there was at least state financial losses according to the value paid to the provider of Rp169,823,791.00.
