ASN Corruption Infak Fund For Grand Mosque Of West Sumatra Sentenced To 7 Years In Prison

PADANG - West Sumatra (West Sumatra) Provincial Civil Apparatus (ASN) Yelnazi Rinto was sentenced to 7 years in prison. He was declared proven guilty of misappropriation of donations from the Great Mosque of West Sumatra as well as corruption of a number of other budgets

"To declare that the defendant is legally and convincingly guilty of continuing the criminal act of corruption, imposing a sentence of seven years," said Chief Judge Yose Ana Roslinda in the verdict quoted by Antara, Friday, February 5.

The Amar was read by the presiding judge during the verdict reading trial at the Padang Corruption Court. The Panel of Judges also imposed a fine of IDR 350 million, a subsidiary of four months in prison and paid a compensation of IDR 1,754,979,804.

Provided that if they are not paid no later than one month after the court's decision is legally binding (inkracht), the property will be confiscated and auctioned off.

"If the defendant does not have sufficient assets to pay replacement money, it will be replaced by imprisonment for three years," he said.

The Panel of Judges sentenced the defendant because he was legally and convincingly proven guilty of committing a criminal act of corruption continuously according to the first primary indictment, Article 2 paragraph (1) Jo. Article 18 of the Corruption Act Jo. Article 64 paragraph (1) of the Criminal Code, causing state losses amounting to Rp1,754,979,804.

In the judge's consideration, it was stated that it was burdensome for Yelnazi Rinto because he did not support the government's program in eradicating corruption, and had taken money from the Great Mosque of West Sumatra.

Responding to the verdict, the defendant Yelnazi Rinto, who was accompanied by the Legal Advisor (PH) from the Legal Aid Center (Pusbakum) of the Padang District Court, Rifiena Nadra Cs, expressed a thoughtful attitude. Likewise with the Padang Public Prosecutor's Prosecutor, Pitria Erwina.

The case that ensnared Yelnazi Rinto was the alleged misappropriation of donations from the Grand Mosque of West Sumatra and a number of other funds. First is the Supply Money (UP) at the West Sumatra Provincial Secretariat Binsos Bureau (now called the Mental Kesra Bureau) for the 2019 budget year amounting to IDR 799.1 million.

"The defendant transferred money from the Bureau account to a number of accounts, ostensibly to pay for Bureau activities," said the prosecutor.

The second is donations or alms from the congregation of the Great Mosque of West Sumatra in 2013-2019 with a budget of IDR 857.7 million.

The third is money in the Zakat Collection Unit (UPZ) Tuah amounting to Rp. 375 million by transferring it first to the account of the Grand Mosque of West Sumatra, then withdrawn personally.

Finally, the remaining money for the 2018 Islamic Holidays (PHBI) fund was IDR 98.2 million which was also allegedly used for personal gain.

The defendant's actions were said to have caused state financial losses amounting to Rp1,754,979,804, based on the report on the calculation of state financial losses by the West Sumatra Inspectorate Number: 11 / INS-Case / VII.2020 dated July 28, 2020.
