The Return Of The Discussion On The Personal Data Protection Bill By The DPR
JAKARTA - In today's digital era, personal data is one of the important things that cannot be ignored. Moreover, this country is considered to be the largest social media user, which is quite vulnerable to the theft of personal data.
Therefore, the government through the Ministry of Communication and Informatics (Kominfo) and Commission I of the DPR are committed to finalizing the draft of the Personal Data Protection Law (RUU PDP). The discussion of this bill will begin in early 2020.
The commitment was stated in the concluding points of the hearing between Kominfo and DPR Commission I which took place on Tuesday (5/11). The Minister of Communication and Information, Johnny G Plate, promised to push this bill to become a priority in the 2020 National Legislation Program (Prolegnas).
"It is targeted that in December this year the draft bill will be sent to the DPR so that it can be discussed with the DPR from January to July 2020. It is hoped that it will be passed into law in October," said Johnny at the DPR, Parliament Complex, Senayan, Jakarta.
The regulation regarding the protection of personal data has actually been stipulated by the Minister of Communication and Information Technology (Menkominfo), Rudiantara, in the form of Ministerial Regulation (Permen) No. 20 of 2016. However, the regulation is more of an internal nature, to ensure that telecommunications operators who store customer personal data do not use it arbitrarily.
Until finally, this bill was returned to Kominfo after several points of the rules were corrected by the Ministry of Home Affairs (Kemendagri) and the Attorney General's Office, in mid-October. Following are the points of the revised PDP Bill:
- Article 7 of the PDP Bill on the right to update and or correct personal data. - Article 20 regarding the agreement in which there is a request for personal data. - Article 1 point 7 of the PDP Bill regarding the definition of a corporation.
- Article 10 of the PDP Bill regarding the right to submit objections.
- Article 17 paragraph 2 letter a of the PDP Bill on the principle of protecting personal data. - Article 22 paragraph 2 concerning exceptions for the installation of visual data processing or processing equipment.
- Article 44 of the PDP Bill regarding the exemption from the obligation to control personal data.
In fact, the PDP Law is considered increasingly important, considering that the trend of big data has spread to various lines. People also knowingly or unknowingly have submitted personal information to various internet services.
It is not only private companies that collect personal data from users, but also the government. One of them is seen from the obligation to register prepaid SIM cards with NIK and KK.
Sovereignty of personal data
Previously, President Joko Widodo (Jokowi) had particularly highlighted the importance of personal data sovereignty. He conveyed this in a state speech in the context of the 74th Anniversary of the Republic of Indonesia at a joint session of the DPD and DPR, Friday (16/8).
Jokowi said that the issue of protecting personal data is currently a hot topic of discussion, particularly in connection with the rampant cases related to privacy violations and misuse of personal data.
"Data is a new type of wealth for our nation, now data is more valuable than oil. Therefore, data sovereignty must be realized. Citizens' rights to personal data must be protected. The regulations must be prepared immediately and there is no compromise," Jokowi said as quoted from page detik. com .
President Jokowi's statement was responded to by General Chair of the Indonesian Internet Service Providers Association (APJII) Jamalul Izza. According to him, with the increasing number of internet users in Indonesia, namely 171.17 million people, it is absolutely necessary that the regulation of personal data protection must be issued immediately.
According to Jamal, in today's digital era, the protection of personal data has become increasingly urgent. Based on data from the survey data on penetration and behavior of internet users in Indonesia conducted by APJII and the 2018 Indonesian Polling, it noted that social media such as Facebook, Instagram and YouTube were the most visited.
"Especially on social media, there are many people's personal data that is easily obtained. Therefore, APJII supports the efforts of the government to immediately prepare the regulation," he said.
