When Evidently Falsified Pilkada Documents, Orient Can Cancel Becoming Regent Of Sabu Raijua
JAKARTA - The elected regent of Sabu Raijua Orient Regency Patriot Riwu Kore is suspected of committing an election violation because he falsified population documents as a condition for nominating regional heads in the 2020 Pilkada.
Despite completing the requirements, namely having an Indonesian citizen ID (WNI), it turns out that Orient also has the status of a citizen of the United States.
According to Perludem Advisory Board Member Titi Anggraini, Orient can be canceled from the appointment of the elected regent of Sabu Raijua if he is proven to have committed the crime.
Based on Article 164 Paragraph 4 of Law Number 10 Year 2016 Concerning Pilkada, regional head candidates may not be inaugurated due to death, permanent absence, or resignation.
"Because this is not a matter of dispute over the results of the vote, and he is already in the SK to become an elected candidate, while he is a foreigner, it means he does not meet the requirements and can be positioned permanently unable to stay," said Titi to VOI, Wednesday, January 3.
However, this does not mean that the election results are invalid and that a re-vote is necessary. This is because the Orient pair, namely the elected Deputy Regent of Sabu Riajua, Thobias Uly, still meets the requirements.
Therefore, if Orient is proven to have violated the election and is dismissed as regent, Thobias Uly will still be inaugurated.
"So, later the deputy will remain inaugurated. After being inaugurated, because the regional head is unable to stay, only then will the deputy replace his position as regent," said Titi.
For information, the Election Supervisory Agency (Bawaslu) of Sabu Raijua Regency found out that the elected regent of Sabu Raijua, Orient Patriot Riwu Kore, was actually a citizen of the United States (US).
Based on a report from the East Nusa Tenggara General Election Commission (KPU), Orient, when he registered as a candidate for Regent of Sabu Raijua last September, he submitted the requirements for population data, namely an electronic KTP as an Indonesian citizen.
Orient population data has also been verified to the Department of Population and Civil Registration (Disdukcapil) Kupang City. As a result, the Kupang Disdukcapil confirmed that Orient was a resident of Kupang City.
If proven to have forged documents, Orient could be charged with imprisonment. Based on Article 184 of Law Number 1 of 2015, it is stated that any person who deliberately provides false information or uses a fake letter as if it were a valid letter about something necessary for the requirements to become a candidate for regional head shall be punished with the shortest imprisonment. 36 months and a maximum of 72 months (6 years) and a fine of at least Rp. 36 million and a maximum of Rp. 72 million.
