File For Free Sentence Cassation, KPK Disbursed Panic By Supreme Court Justice Gazalba Saleh After The KPK Holds OTT In The Supreme Court
JAKARTA - Inactive Supreme Court Justice Gazalba Saleh is said to have panicked when he learned of a hand arrest operation (OTT) within the Supreme Court (MA) related to case management. In fact, he had changed his cell phone number.
This was conveyed by the Corruption Eradication Commission (KPK) in the memorandum of cassation submitted to the Supreme Court. This submission is to fight the acquittal against Gazalba.
"As a tangible form of concern, the defendant after the KPK OTT then changed his cellphone number from the old one with a new cellphone number," said Head of the KPK News Section Ali Fikri to reporters, Tuesday, August 22.
Not only that, Gazalba also deleted the message he sent with Prasetio Nugroho, who is his assistant. This has been opened at trial some time ago.
"The Prosecutor's Team also believes that digital traces will never be able to lie," he said.
Gazalba's actions are also considered to have violated the rules. Because, deleting a chat means it is tantamount to eliminating evidence.
"The actions of both the defendant and Prasetio Nugroho who have deleted WA chats, especially as law enforcement officers, especially as judges who serve in criminal rooms, should understand the prohibition on eliminating evidence," said Ali.
Previously, Gazalba was acquitted in the trial of alleged bribery in handling the case at the Supreme Court (MA). The KPK was deemed insufficient evidence by the Panel of Judges at the Bandung Corruption Court. In this case, Gazalba was sentenced to 11 years in prison by the Public Prosecutor (JPU). He is alleged to have received a bribe of 20 thousand Singapore dollars for case management at the Supreme Court. KPK prosecutor Wawan Yunarwanto said the charges were filed based on the conclusions of the facts of the trial, ranging from witness statements, instructions, to evidence presented. "So that the panel of judges decides, stated that the defendant Gazalba Saleh was proven legally and convincingly guilty. Sentencing him a sentence of 11 years in prison and a fine of Rp. 1 billion subsidiary 6 months in prison," said Wawan at the Bandung Corruption Court, Thursday, July 13. The prosecutor explained that Gazalba allegedly accepted bribes to grant the applicant's request, namely Heryanto Tanaka, to grant an appeal case related to the Intidana Savings Savings Cooperative (KSP) problem. According to the prosecutor, the bribe money prepared by Heryanto Tanaka to take care of the case reached 110 thousand Singapore dollars. Then the money was channeled by a chain, ranging from lawyers, ASN in the MA environment, to Prasetio Nugroho as the substitute clerk or assistant who is a representation of Gazalba Saleh.
