Conditional Leave, Bharada E Stays Under Supervision And Must Report
Head of the Regional Office of the Ministry of Law and Human Rights of DKI Jakarta Province, Ibnu Chuldun, said that a number of parties were still supervising Richard Total Pudihang Lumiu or Bharada E who had been on conditional leave since August 4.
"There is no escort, but there is only supervision. The supervision is not only carried out by our side, the Fathers, but also from the local prosecutor's office," he said when confirmed, Friday, August 18.
Ibnu further explained that Bharada E received conditional leave since August 4.
"So E can get a conditional leave, then he follows the guidance at the Central Jakarta Correctional Center (Bapas), even though the guarantor is in Manado," he said.
Ibnu explained, meaning that Bharada E is obliged to report once a week, then fill in attendance until the guidance period is over.
"(Reporting obligations) Until the end of his sentence, his conditional leave. The end of next year. Next year (Bharada E) is purely free. Now he is released on condition, the condition is that he is obliged to report to the Fathers and carry out guidance," he said.
Even though he has made conditional leave, Bharada E can also go out of town but must ask permission from the Head of the Fathers concerned.
"For example, if he has a need outside the city to take care of his school, or to visit his parents or family, for example, he may do that permit but must get permission from the Head of Fathers. However, it is not immediately, later a PTP trial will be held at the Fathers regarding how progress is as long as he follows the guidance at the Fathers. Whether there was a absence, whether he ever came or so, it influenced the person concerned," he explained.
Meanwhile, based on Article 114 of Law Number 22 of 2022 concerning Corrections, Bharada E is given the right to undergo the Conditional Leave (CB) program for six months until January 31, 2024.

As is known, Richard Totaling Pudihang Lumiu or Bharada E is currently spending time with his family. This moment occurred after he received conditional leave from the Directorate General of Corrections (Ditjen) of the Ministry of Law and Human Rights and left the prison.
"It's out and is now with the family," said Bharada E's lawyer, Ronny Talapessy, to reporters in a written statement, Tuesday night, August 8.
Ronny said his client was in good health. The former subordinate of the former Head of the Propam Police Division, Ferdy Sambo, will continue to be supervised by the Directorate General of PAS during his conditional leave.
"Please pray and support all for Icad during the leave process, we are still under the supervision of the Directorate General of PAS of the Ministry of Law and Human Rights," he said.
Bharada E should have been released purely in January next year. He was sentenced to 1 year and 6 months in the murder case.
