Semen Bosowa Was Sued By PKPU In Medan District Court

JAKARTA - PT Semen Bosowa Indonesia was sued for Postponement of Debt Payment Obligation (PKPU) at the Medan District Court (PN). The plaintiff was named Abdul Rajab R.

Quoted from the Medan District Court Case Tracing Information System, the lawsuit was registered on Tuesday, December 15, 2020 with case number 43 / Pdt.Sus-PKPU / 2020 / PN Niaga Mdn.

In the petitum submitted by Abdul Rajab, he asked the Medan District Court to accept and grant all PKPU requests that he submitted to Bosowa.

"To declare that the PKPU or PT Semen Bosowa Indonesia Respondent is in a temporary suspension of debt payment obligations (PKPU) with all the legal consequences for a maximum of 45 days from the time the a quo decision was pronounced," said the petitum, quoted by VOI, Monday February 1

To oversee the legal process, Abdul Rajab appointed David ML Tobing, John Herman Pigalao, and Prama Arta Rambe as the management team in the PKPU Semen Bosowa process.

The PKPU case that ensnared Bosowa has received an interim decision after going through 5 trials. The interlocutory decision was issued by the Medan District Court judges on Tuesday, January 5, 2021.

In this decision, the Medan District Court panel of judges granted the PKPU request submitted by Abdul Rajab.

"Determine that the PKPU (debtor) PT Semen Bosowa Indonesia respondent is in a state of Postponement of Debt Payment Obligation (PKPU) temporarily, at most 45 days," said the interim decision.

Furthermore, the Medan District Court will again hold a hearing on the case on Friday, 19 February 2021. This trial will be attended by Semen Bosowa and Abdul Rajab.

"Ordered the management team to summon the PKPU defendant or debtor and creditors known by registered mail or via courier to come on the day of the trial which will be held on Friday, 19 February 2021, at 09.00 WIB in the Commercial Court courtroom at the Medan District Court, "said the interlocutory decision.

Semen Bosowa Indonesia is a part company of Bosowa Corp, a conglomerate founded by Indonesian businessman Aksa Mahmud who was originally named CV Moneter in the city of Makassar, South Sulawesi.

VOI tried to contact Bosowa Corporindo President Commissioner Erwin Aksa via WhatsApp messages and phone calls to confirm the lawsuit. However, until this news was published, Erwin Aksa had yet to give his response.
