Prof. Indriyanto: Hanura Cadre Supporting Jokowi Detained Showing Non-Discriminative Law
JAKARTA - University of Indonesia criminal law expert Indriyanto Seno Adji emphasized that the determination of the suspect Hanura Ambroncius Nababan, a Jokowi supporter in the 2019 Presidential Election, is proof of non-discriminatory law.
"The state does not tolerate racist issues or contains SARA (ethnicity, religion, race and intergroup)," said Indriyanto as quoted by Antara, Thursday, January 28.
Indriyanto appreciates law enforcement for alleged racism against Natalius Pigai in line with the appointment of the Chairman of Pro Jokowi-Amin Volunteer (Projamin) as a suspect.
According to him, Ambroncius' arrest indicated that law enforcement was equal, non-discriminatory, and did not consider his political background.
On the other hand, he said, the legal process against Ambroncius could also reduce public tension.
"This legal process can also reduce public tension. However, if the parties are wise with a restorative justice approach, the legal process should not have to come before the legal process," he said.
Meanwhile, member of Commission III of the DPR from the PDI-P faction Masinton Pasaribu said that the state should not give space to the issue of racism. Anyone who is racist, he said, must be brought to justice.
"We must not tolerate racism and the state must act firmly. The basic law or the constitution of our country adheres to equality before the law," said Masinton.
Ambroncius was suspected by Article 45a Paragraph (2) in conjunction with Article 28 Paragraph (2) Law Number 19 Year 2016 Amendments to the ITE Law and Article 16 jo. Article 4 Letter b Paragraph (1) of Law Number 40 Year 2008 concerning the Elimination of Racial and Ethnic Discrimination and also Article 156 of the Criminal Code.
The police have arrested Ambroncius from running away and have lost evidence.
Before being arrested, Ambroncius apologized to the Papuan people. He emphasized that there was no intention of insulting the Papuan people.
