There Is No Explanation From The Pandeglang District Court On How To Supervise The Judge's Verdict For Prohibiting The Defendant Of 'Revenge Porn' Internet Access 8 Years
PANDEGLANG - Spokesperson for the Pandeglang District Court, Banten Province, Panji Answiinartha, said the additional punishment for the defendant Alwi Husen Maolana in the "revenge porn" case (spreading pictures/sexual videos) was a legal breakthrough.
But how to oversee this additional sentence from the judge? The Pandeglang District Court did not provide an explanation.
"Because, in the Information and Electronic Transactions Law (UU ITE) it is not specifically regulated regarding the additional crime," Panji said after the trial of the defendant's verdict in the case of criminal acts of distributing immoral videos in Pandeglang, reported by ANTARA, Thursday, July 13.
The additional sentence breakthrough was handed down by the defendant in the form of confiscation of certain rights, namely the prohibition of using internet-based communication devices for eight years.
Then, all data or electronic information such as flashdisk, print out and electronic files related to the case were destroyed. Where, it was not requested by the public prosecutor.
"In fact, the additional criminality of confiscation of certain rights imposed by this judge is outside of the types of confiscation of rights regulated in the Criminal Code (KUHP)," he explained.
One of these considerations is to maintain or educate the public not to do the same thing.
"If you take a similar action like the current defendant, then the result of the sentence will be the same," he asserted.
According to him, the decision reflected the seriousness of the court in handling cases of violations of the spread of immoral videos, which are increasingly occurring in the digital era.

Previously, the Chief Justice of the Pandeglang District Court, Hendy Eka Chandra, read out the verdict at the trial, sentenced him to six years in prison and a fine of Rp. 1 billion, subsidiary to three months in prison, to the defendant in a criminal case of distributing immoral videos.
