MA Cancels KPU Decision On Disqualification Of Bandar Lampung Pilkada Winner Eva-Dedy
JAKARTA - The Supreme Court granted the request for Mayor and Deputy Mayor of Bandar Lampung, Eva Dwiana-Deddy Amarullah. MA canceled the decision of the Bandar Lampung KPU to disqualify the pair number 3.
"Yes, it is true that the Supreme Court granted it," said Supreme Court spokesman Andi Samsan Nganro as quoted by Antara, Wednesday, January 27.
In the decision for case Number 1 P / PAP / 2021, the Supreme Court ordered the Bandar Lampung KPU to revoke decision Number 007 / HK.03.1-Kpt / 1871 / KPU-Kot / 2021 dated January 8, 2021 concerning the Cancellation of Candidate Pairs for Mayor Election and Deputy Mayor of Bandar Lampung in 2020 against Eva Dwiana-Deddy Amarullah.
The Bandar Lampung KPU was also ordered to re-establish Eva Dwiana-Deddy Amarullah as participants in the Bandar Lampung regional election by issuing a new decision.
The decision handled by Supreme Court Justices Supandi, Is Sudaryono and Hary Djatmiko was issued on January 22, 2021.
According to the Panel of Judges, the reasons for Eva Dwiana-Deddy Amarullah were based on law, including the suspicion of having committed a structured, systematic and massive administrative violation (TSM), the pair admitted that they had never given promises, money or materials to vote for them.
In consideration, the Supreme Court views that social assistance distribution activities due to COVID-19 are a work program that must be carried out by regional heads based on instructions from the Minister of Home Affairs.
Previously, the Bandar Lampung KPU determined the results of the recapitulation of candidate pair number 3 Eva Dwiana-Deddy Amarullah to get 249,241 votes, candidate pair number 2 M Yusuf Kohar-Tulus Purnomo 93,280 votes and candidate pair number 1 Rycko Menoza-Johan Sulaiman 92,428 votes.
However, the Lampung Bawaslu stated that the Eva Dwiana-Deddy Amarullah pair had violated the TSM so that the Bandar Lampung KPU issued a decision to disqualify the pair.
