JAKARTA - Hanura Party cadre Ambroncius Nababan faces a maximum sentence of 5 years in prison. Ambroncius became a suspect in the case of uploading a photo of Natalius Pigai alongside a gorilla.
"The threat of the sentence is more than 5 years (imprisonment)," said Head of Public Relations of the National Police, Inspector General Argo Yuwono, to reporters, Tuesday, January 26.
In this case, the investigator uses Article 45A paragraph (2) Jo Article 28 paragraph (2) Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions, and/or Article 16 Jo Article 4 letter b paragraph (1) of Law Number 40 of 2008 concerning the elimination of racial and ethnic discrimination and/or Article 156 of the Criminal Code.
However, Argo continued investigators have yet to decide the detention of Ambroncius Nababan. Because after being arrested, Ambroncius had to undergo a series of investigations as a suspect.
"Tomorrow we will convey (about the detention) because today, it is still in the 1x24 hour process for the investigator as a suspect," said Argo.
Ambroncius Nababan was named in the case of alleged hate speech with racial elements. The determination of the suspect is based on the case title.
"Then after the case title was carried out, the conclusion of the case title was to increase the status on behalf of AN to become a suspect," said Argo.
Ambroncius Nababan previously admitted that the post was his act. But the post was not intended to insult but to criticize Natalius Pigai.
"There is nothing (racist). (Just to) criticize," said Ambroncius.
The criticism, said Ambroncius, was directed at Natalius Pigai because he did not believe in the Sinovac vaccine. But his disbelief was expelled to the public. So, it can interfere with government programs.
Regardless of the reasons behind it, Ambroncius admitted that the post was his doing. However, for the gorilla image alongside Natalius Pigai's photo, Ambroncius admitted to getting it from one of his colleagues.
