Satpol PP Seals Unlicensed Kandara Village Housing In Maguwoharjo Village Land, Sleman

The Yogyakarta Special Region Civil Service Police Unit (Satpol PP) sealed the Kandara Village residential area which was built illegally on village treasury land in Pugeran Hamlet, Maguwoharjo Village, Depok District, Sleman Regency.

The sealing of housing with the concept of villas and resorts developed by PT Indonesia International Capital was carried out on Tuesday (16/5).

"We have sent summons to the developer twice which was entrusted to the local RT because the marketing office has been vacated and no one has been summoned. We have summoned and did not come twice, so the team collected data and evaluated and agreed to close the building first," said the Head of the DIY Satpol PP Noviar Rahmad as reported by ANTARA, Wednesday, May 17.

Noviar said that the residential development was known to have not obtained a permit to use the village/kelurahan Maguwoharjo treasury land covering an area of 39,595 square meters.

The mode used by developers is to deceive the public, he said, as was the case with the suspect in the abuse of village treasury land in Caturtunggal, Depok, Sleman previously, which was to offer cheap housing.

Noviar revealed that on the village treasury land used by the developer, it turned out that 150 housing units had been established and 30 percent of them had been occupied with the handover of keys at the end of March 2023.

In principle, said Noviar, the property owner had violated Article 23 paragraph (2) of the DIY Regional Regulation Number 2 of 2017 concerning Peace, Public Order, and Community Protection.

In addition, the owner of the "Kadara Village" property has violated the Yogyakarta Governor Regulation Number 34 of 2017 concerning the Utilization of Village Land which states that the use of village treasury land for leases must obtain permission from the Sultanate or Kadipaten.

The regulation states that village treasury land should not be used for the establishment of residential houses and traded.

"After the sealing, the Inspectorate will calculate the amount of losses incurred. There will be further settlements later," he said.

After the act of forced sealing property, Noviar stated that the next step for the Governor of Yogyakarta would ask for an Audit Result Report (LHP) and a State Financial Losses Report on the village treasury land.

Furthermore, the case will be forwarded to the realm of law by summoning the parties involved and conducting investigations.

"In this case, we are guided by the DIY Governor Regulation Number 87 of 2012 concerning Procedures for Non-Yustial Control. Efforts to seal unlicensed property are non-judicial. Later it will only enter the criminal realm whose key is to the Governor of Yogyakarta," said Noviar.

So far, the DIY Satpol PP has closed and sealed a total of four properties built on village treasury land and did not have a permit.

Therefore, the Head of the Enforcement and Investigation Section of the DIY Satpol PP Qumarul Hadi appealed to the public if they wanted to invest in property to check documents as a whole and ensure that it was valid first.

"We ask the public to be careful in investing in property, especially those that are not clear. This means that all information must be checked up to the status and ownership of land because the consequences will lose on their own if they do not know," said Qumarul.
