Appeal Decision Rejected, AG Will File Cassation
JAKARTA - AG's attorney, Mangata Toding Allo, plans to appeal the sentence of 3.5 years in prison at the Social Welfare Administration Agency (LPKS) related to David Ozora's premeditated severe abuse case. He said this after getting approval from the family.
"We have received approval from the family for Cassation," Mangata told reporters in the Tebet area, South Jakarta, Thursday, May 4.
He explained that the cassation attempt would be submitted to the Supreme Court (MA) next week. Then, his party will also send a memorandum of appeal which has also been tried at the DKI Jakarta High Court.
"Next week is the final limit on May 11, (2023), we have asked the District Court for a statement. Then for the maximum cassation memory on May 25," he concluded
Previously it was reported that the DKI Jakarta High Court officially rejected the appeal filed by the defendant AG at the appeal hearing at the DKI Jakarta High Court on Thursday, April 27. The appeal hearing was chaired by Judge Budi Hapsari.
After receiving AG's request for an appeal, the judge actually upheld the decision of the South Jakarta District Court. The defendant AG must also serve the sentence according to the South Jakarta District Court's decision.
"Strengthening the decision of the South Jakarta District Court Number 4/Pidsus Anak/2023/PN South Jakarta dated April 10, 2023, which was requested," Budi Hapsari said in a hearing, Thursday, April 27.
"Determining the period of arrest and detention that AGH's child has served is reduced entirely from the sentence that has been imposed," he added.
In addition, the defendant AG's child was also determined to remain in detention. In the appeal trial, the judge determined that children and parents pay court fees at an appeal rate of 2 thousand rupiah.
"Setting AG's child remains in custody," he continued.
The results of this appeal decision actually strengthened the verdict of the South Jakarta District Court against the defendant, AG's son.
