WNI Ex-ISIS Will Not Have Citizenship After Jokowi Signs The Presidential Decree
JAKARTA - As many as 689 former ISIS Indonesians have lost their citizenship. According to the Coordinating Minister for Political, Legal and Security Affairs (Menkopolhukam) Mahfud MD, the loss of citizenship occurred because it was regulated in Law Number 12 of 2006 Article 23 concerning citizenship.
"According to the law, people lose their citizenship status for several reasons, including participating in the activities of foreign soldiers. That is according to Law Article 23 paragraph 1 point D," Mahfud told reporters when asked about the status of former ISIS citizens at the Kemenkopolhukam Office, Jalan Medan Merdeka. West, Central Jakarta, Thursday, February 13.
The process of revoking citizenship, said Mahfud, could be carried out by the president according to Government Regulation No.2 of 2007. However, the process must be carried out through an administrative legal process which was scrutinized by the minister and determined by President Joko Widodo (Jokowi).
He also denied the statements of a number of parties stating that these ex-ISIS Indonesians had to carry out the law in court first and then their citizenship could be revoked.
"Administrative law is regulated in articles 32, 33, that the minister will examine it, after okay handing over the president, the president will issue a legal process called an administrative legal process so it is not a court process," he said.
"So, don't argue me with Pak Moeldoko. Pak Moeldoko is right, automatically loses citizenship status," he continued.
It is known that the Presidential Chief of Staff Moeldoko said this afternoon that 689 Indonesian citizens who were former ISIS members were stateless or stateless.
The reason is that they have burned green passports which are proof that they are Indonesian citizens and on their own accord left to join ISIS.
"Yes, they themselves claim to be stateless. Burning passports is an indicator," said the former TNI commander at the Presidential Palace Complex, Jakarta, Thursday, February 13.
Meanwhile, for those who still have green passports, the government will carry out verification and from this result their fate will be determined. According to Moeldoko, this is the result of a meeting that was held some time before.
For information, Law number 12 of 2006 concerning Citizenship Article 23 letter i explains how an Indonesian citizen can lose his / her status. This is stated in chapter IV which is written as follows:
"Residing outside the territory of the Republic of Indonesia for 5 (five) years continuously not in the framework of state service, without valid reasons and deliberately not expressing his desire to remain an Indonesian citizen before the 5 (five) year period expires. , and every 5 (five) years the person concerned does not submit a statement of wanting to remain an Indonesian citizen to a Representative of the Republic of Indonesia whose working area includes the residence concerned, even though the Representative of the Republic of Indonesia has notified him in writing, as long as he does not become stateless. "
