JAKARTA - The police have explained the reasons for not determining the health personnel (nakes) Wisma Atlet as a suspect in a nasty case. Because in this case, the articles used in this case are related to the dissemination of pornographic content.
"Because our Law does not yet regulate (obscene). We emphasize that what we set in the ITE Law is related to spreading pornographic or immoral content," said Head of Criminal Investigation Unit for Central Jakarta Metro Police, AKBP Burhanuddin to reporters, Tuesday, January 19.
By using the ITE Law, these health workers cannot be subject to criminal charges. This is because the perpetrator of the spread of pornographic content is a COVID-19 patient with the initials JM.
"Because he spread it (so that) he became a suspect," said Burhanuddin.
Meanwhile, for health workers, Wisma athletes did not share it so that they could not be charged with criminal law. However, based on the information received, there have been sanctions given in the form of dismissal from work.
"The person concerned has been deactivated (as a health worker for the Athlete House)," said Burhanuddin.
The suspect JM was charged with Article 36 concerning pornography and Article 45 paragraph 1 and Article 27 paragraph 1 concerning ITE. Thus, the threat of imprisonment for a maximum of 6 years and a fine of Rp1 billion.
