JAKARTA - The candidate pair for Regent and Deputy Regent of Kotawaringin Timur, Central Kalimantan, candidate number 1, namely Halikinnor and Irawati or familiarly called HARATI, collaborates with former Chief Justice of the Constitutional Court Hamdan Zoelva and Heru Widodo, a former legal expert for the Joko Widodo-Ma'ruf Amin pair in dealing with disputes. election of regional heads to be heard in the Constitutional Court.

The election for the regional head of East Kotawaringin Regency (Kotim) on December 9, 2020, was attended by four pairs of candidates for regent and deputy regent.

Based on the results of the recapitulation of the vote count results by the Kotawaringin Timur General Election Commission on Tuesday (15/12/2020) last night, the Halikinnor-Irawati (HARATI) pair received 56,536 votes, Suprianti Rambat-Muhammad Arsyad (SUPER) received 44,105 votes, Muhammad Taufiq Mukri-Supriadi (PANTAS) received 20,353 votes, and Muhammad Rudini Darwan Ali-Samsudin (BERCAHAYA) received 47,161 votes.

One of the candidate pairs, candidate number 4, Muhammad Rudini Darwan Ali-Samsudin, expressed their objection. The pair with the slogan Kotim Luminous then filed a lawsuit with the Constitutional Court.

For this lawsuit, the Rudini-Samsudin pair were accompanied by a well-known lawyer Fahri Bachmid who was part of the legal team for the candidate pair President Joko Widodo and Vice President Ma'ruf Amin.

In this election dispute, the pair who objected to being the petitioner and the respondent party was the General Election Commission (KPU). The HARATI pair that were determined as winners were determined by the KPU, in this case were related parties.

Hafid said the HARATI pair provided legal counsel through two Advocate Offices, namely Zoelva & Partners Law Firm and Heru Widodo Law Office to apply as a related party.

"The HARATI pair is optimistic that everything will go according to expectations. This is so that there will be certainty quickly so that the KPU can immediately conduct a plenary appointment of elected regents and deputy regents. The success of Kotawaringin Timur should not stop," said Hafid.

The head of the East Kotawaringin General Election Commission, Siti Fathonah Purnaningsih, stated that the step to file a lawsuit at the Constitutional Court is the right of the candidate pair. He emphasized that the KPU is ready to face it.

"We have carried out all stages according to the rules. We are preparing everything to face this lawsuit," said Siti Fathonah.

Siti Fathonah also emphasized that the stages that had been carried out were an open plenary meeting of the recapitulation of the vote count results for the election of the Regent and Deputy Regent of East Kotawaringin. Determination of the elected candidates has not been carried out because there is a lawsuit so they have to wait for the Constitutional Court's decision, then the decision can be made.

Meanwhile, today the Constitutional Case Registration Deed (ARPK) was issued for the applicant and the defendant. The Constitutional Court provided a copy of the applicant to the respondent, the General Election Commission (KPU) and the Regional Election Supervisory Body (Bawaslu) at the same time.

On January 18-20 2021, the schedule for the first trial was submitted to the applicant and the respondent. Preparation for the preliminary examination will take place on January 26-29, 2021.

This process includes checking the completeness and clarity of the applicant's material, checking the contents of the application material, and ratifying the applicant's evidence. The ongoing examination session at the Constitutional Court will take place from 1 to 11 February 2021. This includes the agenda of submitting the respondent's answers, examination of statements of related parties, and statements of Bawaslu.

The Constitutional Court continues the trial by hearing the respondent's answer, statements from related parties, information from Bawaslu, as well as examining and ratifying evidence. This evidence comes from the respondent, related parties, and Bawaslu.

The pronouncement of the verdict or court decision to continue the case will be continued on February 15-16, 2021. If the judge passes the trial, the follow-up trial will run from February 19 to March 18, 2021.

At this stage, the trial has an agenda of hearing testimony from expert witnesses as well as examining and ratifying additional evidence. The final decision on the PHPU case will be read out on March 19-24, 2021.
