PKB Asks High Court To Cancel Central Jakarta District Court Decision On Postponement Of 2024 Elections
JAKARTA - PKB assesses that the sentence of the Central Jakarta District Court (PN) has been legally flawed, which has concluded that the KPU has postponed the 2024 election stage after granting the Prima Party's lawsuit.
"Exceeding his authority in the context of not in accordance with the constitution because there is a postponement of the election," said Deputy Chairperson for the PKB DPP Election Winning Division, Jazilul Fawaid to reporters, Friday, March 3. Jazilul also asked the High Court to cancel the Central Jakarta District Court's decision regarding the postponement of the 2024 election.
According to him, this can be done considering that the Central Jakarta District Court's decision is still not legally binding or permanent. The verdict also, he continued, contradicts the 1945 Constitution and the law which states that elections are held every 5 years.
"So this PN decision does not mean anything because the court can still be corrected on it [High Court]," said the Deputy Chairperson of the MPR.
Jazilul also encouraged all parties to jointly correct the Central Jakarta District Court's decision, including his colleagues at the MPR. He also believes that the KPU will appeal against the election dispute decision which should not be the domain of the District Court.
"Of course the decision to implement the law or make a mistake in deciding it will be at the next level, appeals and cassation will definitely be corrected. I am sure there will be corrections at the appeal level and the KPU will appeal," he said.
Alluding to the issue of the Chairman of the MPR Bambang Soesatyo or Bamsoet who once said that the postponement of elections depended on political parties in parliament, Jazilul emphasized that the MPR had closed discussions about amendments to the Constitution.
For this reason, Jazilul hopes that the 2024 General Election will still be held according to schedule, namely on February 14 next year.
"It's an old event, yes, we just focus on the PN decision where it's only the first level and it doesn't matter what because there is still a next decision at the appeal level. And we at the MPR have also closed the discussion on amendments to the Constitution," he said.
