Central Jakarta District Court Decision Regarding Postponement Of Controversial Elections, KY Investigate Alleged Violations Of Judges' Behavior
The Judicial Commission (KY) assessed that the decision of the Central Jakarta District Court (Jakpus) which granted the Prima Party's lawsuit and sentenced the General Election Commission (KPU) to postpone the election caused controversy.
"The decision in principle raises question marks and controversy in the community," said KY spokesman Miko Susanto Ginting in Jakarta, Friday, March 3, quoted by Antara.
This was conveyed by Miko after KY observed the substance of the Central Jakarta District Court's decision, and the reaction that emerged from the decision.
Miko said the court's decision did not work in a vacuum, because there were aspirations that lived in society sociologically. Including the presence of juridical aspects where compliance with the 1945 Constitution and other considerations such as democratic values.
"All of that is part of what the judge must explore in making decisions," he said.
For this reason, he continued, KY will investigate the decision, especially considering whether there were allegations of behavior violations that occurred. One part of the deepening could be by calling the judge for clarification.
If there is a strong suspicion that there has been a violation of the judge's behavior, then KY will conduct an examination of the judge concerned.
However, it should be underlined, related to the substance of the decision, the right forum to strengthen or change the decision is through legal remedies. Domain KY focuses on aspects of alleged violations of the code of ethics and code of conduct of judges.
Finally, KY will also communicate with the Supreme Court regarding the decision and aspects of the behavior of the relevant judges.
To note, the Central Jakarta District Court granted the Prima Party's lawsuit against the KPU which was filed by the party on December 8, 2022 with register number 757/Pdt.G/2022/PN Jkt.Pst.
The judge sentenced the defendant not to carry out the remaining stages of the 2024 General Election since the decision was pronounced and carried out the general election stages from the start for approximately 2 years 4 months 7 days.
