Ombudsman Ngadu To Jokowi And DPR, Regarding The Ministry Of Finance's Administration

The Ombudsman submitted a complaint to President Joko Widodo (Jokowi) and the relevant DPR regarding the implementation of recommendations for maladministration actions carried out by the Ministry of Finance (Kemenkeu).

"As a form of implementation and compliance with the provisions of the legislation, namely Article 38 paragraph (4) of Law (UU) Number 37 of 2008 concerning the Ombudsman of the Republic of Indonesia, the Indonesian Ombudsman has reported to the DPR RI and the president," said Chairman of the Indonesian Ombudsman Mokhammad Najih as quoted by ANTARA, Wednesday, March 1.

Najih explained that the recommendation was related to the maladministration carried out by the Ministry of Finance based on public reports, namely regarding the not yet implementing of a court decision with permanent legal force by the Minister of Finance Sri Mulyani and related parties.

He said the essence of the issue of public reports, contained in the Ombudsman's recommendation, was that a court decision had not yet been implemented with permanent legal force, approximately nine court decisions.

The decision requires the Ministry of Finance to pay a sum of money to the reporting community.

On the recommendation of the Ombudsman and in accordance with the mandate of Article 38 paragraph (1) of the Indonesian Ombudsman Law, the reported and the reported superior are required to implement the recommendation within 60 days of the receipt.

Next, based on a written response from Sri Mulyani signed by the Secretary-General of the Ministry of Finance, it was stated that the postponement of the implementation of the Ombudsman's recommendation needed to wait for a review of the court's decisions with permanent legal force by the State Obligation Fulfillment Team.

This is in accordance with the provisions of the Decree of the Coordinating Minister for Political, Legal and Security Affairs (Menkopolhukam) Number 63 of 2022 concerning the Team for the Completion of Follow-up Decisions Related to Fulfilling State Obligations.

Even so, continued Najih, the Ombudsman assessed that the reason for delaying the implementation of the recommendation was unacceptable, because the court decisions contained in the Ombudsman's recommendation had permanent legal force for a long time, which was approximately five years ago.

Thus, the Ombudsman reported this to the president and DPR RI to take supervisory steps regarding the implementation of the recommendation from the Ombudsman for the Ministry of Finance.

"Therefore, reporting to the DPR RI and the president is notified to the mass media to be able to participate and participate in overseeing the implementation of the Ombudsman's recommendation for better and optimal public services," said Mokhammad Najih.
